us at the end of the hour and gets tonight's last word. >>> well, today the united states supreme court crushed donald trump, and i mean crushed him. unanimously. all three of the trump-appointed justices joined their six colleagues to deliver donald trump the most legally insulting possible response to a trump lawsuit brought to the supreme court that itself was an insult to the intelligence of every member of the court. when donald trump was desperately rushing to fill ruth bader ginsburg's seat on the court, he said then that he needed that ninth justice in order to rule in his favor in election cases so that he could hold onto the presidency. >> we need nine justices. you need that. with the unsolicited millions of ballots, it's a scam, it's a hoax, everybody knows that, and the democrats know it better than anybody else, so you'll need nine justices up there. >> you're going to need nine justices up there, meaning he was going to need nine justices up there to outlaw millions of mail-in ballots. that's what he was saying he was going to ask them to do and he did. that's donald trump saying, i know i'm going to lose the election with voters, but once i bring a case to the united states supreme court to throw out millions of mail-in ballots, that's how i'll win my second term as president of the united states. donald trump planned to do that, donald trump thought it was in the bag. because he put three of those justices on the supreme court. today the united states supreme court refused to even consider, even hear or consider a case brought to invalidate millions of mail-in ballots in pennsylvania. donald trump was expecting his united states supreme court to issue an historic opinion invalidating pennsylvania's mail-in ballots and instead -- instead -- he got this. this piece of paper. i'm not sure if the light can show you this correctly, but it's this tiny little piece of print here. that's the whole thing. this is the supreme court's way of saying, you are out of your mind. it is an order from the supreme court. it does not have any justices' names attached as the authors of the order, which means it is a unanimous order of the united states supreme court. and it simply says the request to hear the case by the supreme court is denied. they don't even bother to give a reason for the denial because the case itself is so preposterous, so insulting to them, that anyone would try to bring such a case to the supreme court, denied. two hours before the supreme court issued that denial to hear donald trump's case about pennsylvania ballots, donald trump publicly called on the supreme court to save him. >> let's see whether or not somebody has the courage, whether it's a legislator or le legislatures, let's see if they can do what's right. >> yes, the supreme court did have the courage to do what's right. in fact, it didn't take any courage at all, it was simply following the legal principles which donald trump knows nothing about. donald trump stood at the microphone today, and with the words you just heard him say, he insulted the united states supreme court to publicly ask the justices to corrupt themselves for him, and then they insulted him right back by doing the right thing and doing it in one sentence. and this insult exchange between donald trump and the supreme court, including the supreme court justices who donald trump thinks he owns, occurred on safe harbor day. happy safe harbor day. it's not a day we usually notice, but it is a day set in 19th century federal law that says that all states that have certified their election results six days before the electoral college meets cannot have those election results overturned by congress when the electoral college presents its results to congress in january. in other words, joe biden's election as president today officially entered the safe harbor of federal law where it has become absolutely impossible legally to undo joe biden's electoral college victory. now, that has actually been impossible all along since joe biden was declared the winner by nbc news and other news organizations on november 7th, but the safe harbor just makes the impossible all the more impossible. the lawyer who was leading the charge in donald trump's frivolous lawsuit attacks on the election spent safe harbor day in the hospital being treated for covid-19. perhaps in his hospital bed, someone read to rudy giuliani the one sentence, unanimous order by the united states supreme court, not just denying rudy giuliani's claims, but in the court's circumstanpect essentially calling everything rudy giuliani has been up to utterly insane. a group of law professors which includes law professor lawrence traver asking bar associations to discipline rudy giuliani and other lawyers for making provingly false claims in and out of courtrooms about the election. and on this safe harbor day, the people who will be president and vice president of the united states of america in just 43 days formally announced the leaders of their administration's team fighting the coronavirus, including california's attorney general xavier becerra, director of health and human services, and dr. anthony fauci continuing in his role as infectious doctor of allergies and diseases and serving as president-elect biden's chief adviser. while the president was the night tonight, those winds will start to build along the coastline we look toward tomorrow, you start out with maybe some 3 to 7 footers in the morning all along the coast west northwest facing beaches watch out for some big time waves building throughout the day by the afternoon. maybe some 1418 footers you see those rolling along the pacific appear that is really going to shake that pyramid and certainly a sight to see but be careful dangerous conditions out there in the water and some very strong rip tides. develop by those waves as well. so it kind of ironic, you know you just have beautiful days outside and all of a sudden we've got huge waves coming in but we still got the storms developing off the coast line they just cannot make it all the way in california to bring us any significant rain yet the kind of shredded by that ridge high pressure and that's where we sit so, yeah, rainfall total so far this season, not impressive in fact, one of the dry start to the season quite some time only half an inch in san francisco, it's 11% of normal, san jose 1300 that's only 5% of look at oakland 1700's only 4% of normal for this time of year santa rosa, less than an inch and a half that's 21% of normal certainly very dry start to the season so far but we can make it up but she's hard to do especially in la nina that we're in right now and a moderate one at that temperatures outside in the 40's and 50's 45 degrees a little more 40 in napa now 41 in the bottle 43 degrees in the you know where we're going when watching temperatures really kind of cooling down these fronts roll toward the coastline. the kind of flatten out this ridge a little bit getting ever so close to bring us a few high clouds but we stay dry and then once that front moves by high pressure builds right back in and we've got some nice clear conditions again and some warm temperatures that's exactly what's going to happen you see the models picking up on that with this front tries to make its way through that ridge just can't do it falls apart. we'll see a couple of passing clouds other than that things stay dry and then we get ready for some warm temperatures in fact i think by tomorrow afternoon, some of these numbers are going to be flirting temperatures up near 70 degrees so you're running well above the average for this time of year overnight lows though getting on the cold side down the freezing mark in concord little more also manioc 40's inside the bay. as we look around the bay tomorrow, you're going to see plenty of sunshine and a couple passing high clouds but look at the temperatures 68 degrees and cocker 68 san jose, beautiful 64 degrees in of all you get the idea unusually warm temperatures by day chilly at night and some big time waves rumlin along the coast. careful yeah, be careful no doubt thanks night. speaking of pacifica fed up and frustrated by seeing bay area leaders and the governor. >>defying their own health orders during the pandemic a pacific a business owner says she and others have had enough, yeah fed up they say even of outdoor dining gets banned again they will continue to stay open and serve customers outside the told our jonathan mccall they want to hold leaders accountable while also protecting their livelihood. >>the owners here at pacifica brewing say that since the pandemic started they have been following the health orders to a team playing by the rules. so they can keep their doors open and keep customers safe when they come inside. they say after seeing the recent news, a big area leaders not practicing what they preach. they say they were forced to take a stand well it's impossible to tell people you cannot go to work and you could not provide for your family, but you must pay your bills helena thrilled and says enough is enough she's no drawing a line in the sand in order to protect her business. >>she says that since last november she and her husband have owned pacifica brewery. >>and since the pandemic her business has been losing some $50,000 a month. like so many other struggling during the crisis. health orders may limit the number of customers from showing up. but those orders don't stop the bills from piling up. that's why she's now on a mission to let bay area leaders know the real impact of their decisions. she's hoping to start a coalition with other businesses who are fed up and frustrated to educate leaders on the real impact of their decisions. she says after seeing recent headlines, the bay area leaders defying their own health orders. she says she's staying open even if outdoor dining is banned. >>we we are all not ignoring any health orders every single guideline has been applied. the only order that were willing to say enough is
