the city has an lbe program that has a disadvantaged component. the transportation authority does not use that program so we'll continue negotiate /w-g them to try to use the city's list. we weren't able to get agreement on that before this meeting, but we'll continue to do that and if we're not able do that we'll comprise the commission of the status of those negotiations, but /tphas the way the agreement is written right now so if there's any change to that we'll let you know as soon as we know. and then secondly for local hiring, sfcta doesn't have an adopted policy in that case, but they eve expressed a preference for the city's local hire policy. after careful consideration of this issue staff is proposing to apply the city's local hire policy on all construction work. this is the approach they would have used if the local hire policy had been in place at that time, but the city only adopted the policy in december 2010 and the agency didn't do any contracts for intrastructure work after that. this is the first one where they'll be applying th

we work with a number of small businesses, dbe and lbe firms. specifically we were at the inception of the bay project and the redevelopment agency as well as others. we also worked or four seasons, kaiser, medical office building, we are currently on central subway projects. we work on anna ray of different projects, our specialty seems to be master developments because it's so diverse on the challenges of getting the contractors to participate whether it's underground utilities, vertical residential, condominium or biotech. we are a dbe firm and we've been here for 15 years. i would like to say our company was pursued with lan ar to manage the program. we are excited about. we have been doing this for 15 years and we have never addressed a program to address the community and more importantly given the resources to achieve it. i would like to elaborate a little bit more. we started in august in this cap program. within our proposal, we were required to have a construction liaison there 50 percent of the team of the opening of the office and we

i've been an lbe for 21 years in this city and i came today to get paid. i was a subcontractor for 13 years on your worker's compensation program. i have an outstanding invoice of $66,000 that you guys have done an investigation on and found out that the crime was in noncompliance of 14b. that amount totals $18 million in contracts over 13 years, of which i was the subcontractor. the 5 percent goal was not met. yet and still in your investigation you saw fit to find out that the $800 million a year contractor who had the contract was in fact in compliance and didn't have to pay. right now i have a $66,000 invoice that's been outstanding with mta for the last 7 months and there have been several, there's been an investigation and on behalf of your compliance officer that found out that my case has merit. that was in the last letter that we received in november the 14th. i came to find out where can i get paid and how quickly can i get paid? right now my doors are closing, my telephones are off and i'm still looking at $66,000. the port has asked me, has hel
