lilly ledbetter is a woman of grace and grit.lly ledbetter, it is great to have you back on the show tonight. thank you for being with us. >> thank you, rachel, for having me. i'm excited to be here to talk about my thoughts about the paycheck fairness act. >> you fought for equal pay at goodyear after you learned that men doing your same job were being paid more than you were being paid. you write about it with emotion and in a very moving way in your book. the paycheck fairness act addresses that specific issue, the issue of how people find out what they're making vis-a-vis their coworkers, literally how you discover you are being discriminated against. do you see it as sort of a companion bill to the bill that bears your name? >> i do. in fact, i've heard someone from the american association of women described it as the hammer for the nail that the ledbetter bill was. the two go together. but i really believe had this been the law back in my day, had this been an act that had been on the books, i could have found out from cow

right now the only thing protects women from this discrimination is the lilly ledbetter act which thet signed in days within enters office. the senate votes on the paycheck fairness act. it would hold companies actable for pay gaps. it stops companies from real waiting against employers who share salary information, and it will often training to women on how to negotiate a fair salary. the bill is expected to fail, but the president is speaking loud and clear. here is how he put it today. >> women still earn just 7 cents for every dollar a man earns over the course of her career, a woman with a college degree will earn hundreds of thousands less than a man doing the same work. at a time when we're in a make or break moment for the middle class, congress has to step up. >> equal pay for equal work. who could be against that. joining me now is senator barbara boxer, thanks for coming on the show tonight. >> it's great to be with you. >> we were talking about this in the office today. can you explain this to me? how can anyone be against a bill that would help close the wage gap? >> no o

the lily ledbetter act worked. in 1936 it was $.59 for every $1. now they're up to $.77.bviously we're not there yet as far as equality. there are factors involved there. but in this paycheck fairness act did three things i don't agree with. it did salaries that are not gender related but the company has to prove it. the company has to say hey--so i agree with suing and saying listen i got proof we are being discriminateed against. but for the companies to say i'm paying sally this and john this for all these reasons. i think it's cumbersome, i agree with. next, employees may discuss salaries. that could cause havoc in the workplace. i make this much. i make that much. you might be in favor regulating and legislating it i'm not in favor. the labor department must educate employees to prevent disparity. i have no problem with that. disthe republicans filibustered it and killed it, president obama put out a statement saying it's incredibly disappointing that in this make or break moment for the middle class senate republicans put partisan politics ahead of their american wo

and peter mentioned a most fit example, the dissent i summarized from the bench in 2007, in lily ledbetter against goodyear tire. and as he said and as most of you know, the case involved a woman who worked as an area manager at a good will plant in alabama. her starting salary in 1979 was in line with the salaries of men performing similar work, but in time her pay slipped so that in the end of 1997, there was a 15% to 40% disparity between ledbetter's pay between her salary and her 15 male counterparts. she filed charges of discrimination with the eeoc and eventually the agency awarded her back pay and damage. the supreme court filed her claim too late. it was incumbent on her, the court said, to file reports of christmas nation. any annual pay decision not contested within 180 days, the court ruled became grand fathered beyond the title 7 of repair. >> a case that can't be made when somebody has been on the job and ginobili good performance records for 20 years, but if you wait until your case is fully baked, when the disparity is steady and large enough to enable you to mount a winnabl

the legislation we're trying to pass would build upon the lily ledbetter legislation. it would allow us to stop retaliation from employers and insure they can discuss wage issues freely with their colleagues. you know, this is america, and you should be able to talk to one of your co-workers, how much money do you make? how much money does she make? without being fired. this is a common sense approach. it's so easy. nine out of every ten americans support this. 90% of americans support our legislation. 81% of men and 77% of republicans support this legislation. once again, republicans across america can recognize what's fair. republicans every place except those elected to congress. republicans in congress disagree. so once again, only republicans are against this common sense approach. the republicans, i repeat, who oppose it are the ones based here in washington as members of congress. the republican nominee, governor romney, hasn't taken a stand on this issue. he should show some leadership and tell his fellow republicans that opposing fair pay for all americans is
