>> lee cowan starting us off in phoenix tonight. lee, thanks. >>> to our justice correspondent pete williams we go. pete, two questions. number one, why did the judge rule the way she did? and what are we looking at next? >> reporter: this is a victory for the obama administration. the judge agreed with the justice department's main attack on the law that it crossed a constitutional line on how far the states can go. judge susan bolton said the law would require police to do so many more checks on people accused of being here illegally that it would overwhelm the government and divert attention from catching terrorists. she said it would mean widespread detention for people here legally while their immigration status was checked. so the judge concluded that the arizona law would interfere with federal immigration law which the states are not allowed to do. her ruling did note that 18 other states are considering following arizona's lead. she said that would burden the federal government even more. now the state can go to the federal

lee cowan is outside the jail with more. lee, good morning to you. >> reporter: good morning, meredith. according to the sheriff's department here between the jail overcrowding situation as well as time off for good behavior, chances are lindsay lohan won't even serve two weeks behind bars. 13 days is what they're predicting, as little as just 13 days of those 90-day sentence. after that it's directly into rehab, again. this morning lindsay lohan is just another inmate in a jumpsuit. all after the kind of circus you'd expect from one of her court appearances. paparazzi on the ground, news choppers in the sky, even glitter thrown from the crowd. but inside court, the big top came down and a somber, tired-looking lohan sat speechless, waiting to be taken into custody. >> all cameras are ordered to be shut off. >> reporter: and when the time came, only a courtroom sketch artist was allowed to record the moment that lohan was taken away. >> she's scared as anyone would be but she's resolute and she's doing it. >> reporter: lohan

nbc's lee cowan is at the courthouse with the latest on all this. lee, good morning to you. >> reporter: well, good morning, matt. if shapiro is, in fact out, it would be the second attorney in as many weeks that lohan has lost. robert shapiro of o.j. simpson fame, has said he would accept the case but only if she agreed to take jail time, which some say is something lindsay lohan is finding hard to accept. since her last court appearance, aside from a few public outings, lindsay lohan has largely stayed off the tabloid radar even checking herself into a drug rehab facility where some say the waiting is wreaking havoc on her nerves. >> she's had trouble sleeping. she's had trouble eating. she ooze been crying a lot. >> reporter: "people" magazine reports she's a fidgety mess. the reality of jailhouse food and jailhouse bedding is now start to go set in. even her tweets sound different.
