david lee miller is live in our new york bureau with more on this story. david lee nobody thinks there is anything joking about it discussion of killing police. >> reporter: no one here is laughing. new york city police are trying to learn the identity of the man who sent out the sweet over over the weekend. they are trying to get a subpoena. the tweet said, quote, we won't make a difference if we don't kill a cop or two. the tweet was posted as the protestors clashed in lower zuccotti park. they are trying to get a subpoena to learn the tweeter's real name. the man behind the tweet has spoke tone a local radio station and newspaper. we know he lives in florida, he's in the military and he says he never actually attended an occupy wall street rally. he says his tweet was simply taken out of context. >> i never told anyone, hey, why don't you go out there and kill a cop today. >> reporter: over the weekend 74 people in new york were arrested including one woman seen on police video elbowing an officer in the face. minutes later she was arrested and handcuffe

david lee miller is trying to piece all this together. it is early on, david lee. what do we have at the moment? >> reporter: most importantly let's say at the outset here that this incident is not believed to be in any way related to terrorism but there were very tense moment this is morning. authorities say a 29-year-old man simply forgot he had fireworks in a backpack. he was boarding a us airways flight to be headed to san francisco. the police say the suspicious items as you mentioned included a glass jar with duct tape and was essentially a homemade m-80. there were other items not identified. they say there was nothing assembled. there was no device. they do not believe any harl was intended. the individual in custody said he had the fireworks was using them in some way to start a business. he was conducting experiments. the fbi, tsa and other law enforcement are trying to speak to his friends and family to determine if that story is true. again, no way connected to terrorism. bill: what problems did this cause, david lee? >> reporter: there were a few tense

david lee miller is live in the new york newsroom. what do we know about the person who made this threat? >> reporter: not a great deal is known about his identity. apparently that tweet took place 11:39 saturday night as at situation began to escalate in lower manhattan after demonstrators and police first clashed this weekend. the nypd is trying to get a subpoena to learn the identity of this individual. the person who made the tweet was in florida and he never attended an occupy rally. he said the tweet was a joke and a short time ago this individual spoke to a local radio station. he described himself as a member of the radio station. he said i never told anyone hey, why don't you kill a cop today. i never said that once. he says he was taken out of context when you look at that tweet. but you have to ask that question how much context is in a tweet when it's limited to 140 characters. he did say we won't make a difference if we don't kill a cop or two today. arthel: new york city police are not worried about context. just like yo

david lee miller watching the developments from our newsroom. david lee?: authorities say the incident at about 5:30 this morning at philadelphia international is not believed to be connected to terrorism. 29-year-old joseph picklow of dallas, pennsylvania, faces a federal charge of destruction of a destructive device after he tried to board a flight with fireworks in his carry-on luggage. he told investigators he forgot the items were in his backpack and had been experimenting with them as part of a new wiz venture -- business venture. the suspicious items included a water bottle filled with flash powder and commercial-grade m-80 fireworks. other items not yet identified are now undergoing testing, and in an abundance of caution the security checkpoint was closed for about 20 minutes while officials established a safe perimeter, but there were no flight disruptions. authorities say it is not uncommon for passengers to forget they have banned items in carry-on luggage, but that's no excuse for breaking the law. >> he is facing serious charges because not a
