now, what does it mean on the legal side? i actually think the idea of free will or what is often referred to as volitional control plays a very big part in legal systems, but i think in the legal systems, we don't mean it empirically. we don't mean it as a factual construct. we don't mean that there is actual an idea that someone has free will and has made a conscious choice and that we can somehow measure it. i think that in the criminal law, what we mean by free will is essentially a conclusion. it's not a premise, it is a conclusion. we have concluded that the person should have and will take responsibility for their action and therefore they had free will and they're going to take the consequences for that. the problem is when we start actually believing the rhetoric, we actually start believing what we're saying, if you think that, if you use free will normatively, used as a value judgment about when somebody should have to take responsibility and you use it that way in the criminal law, what happens is it starts bleedi

should it be legal or not? joining us is dr. sanjay gupta and howard samuels.spoke before about this. you feel very strongly from your own experiences as a personal addict and treating other addicts that it's a real gateway drug, marijuana and we should not be encouraging it to be legalized. >> well, absolutely. i mean, i think that the doctor has a very good point that for medical purposes, marijuana can be very, very useful. but you have to understand, the vast majority of people that use weed use it to get loaded. they use it to get high. and look, i'm not here to say that it's, you know, worse than alcohol. of course, it's not worse than alcohol but why in the world would we legalize another drug so the nation's youth have another substance to abuse and medicate their feelings with? you know, this is to me, the issue. we don't want to go from one extreme reefer madness, which we know is a total exaggeration, but we don't want to go to the other extreme where we legalize this drug and endanger so many young people. we want to find a healthy balance. >> let m
