the legislatures have punted. they fell down on the job. this really is a legislative solution, and we're stuck with it, right? so we're going to do what we can do. so i say that because i don't think there's any health law professor out there who would say that litigation is the solution to a public health crisis. so the question is sort of how can litigation fit into the broader policy landscape? and i think so far we've seen a couple of important benefits of the litigation. one is that it's definitely ratcheted up public attention to the crisis. it doesn't always happen that litigation is making the kind of front-page news that it's making, but it's making it. we're going to have a nationally televised trial. it's really attuned the public's attention to the crisis. it's also already prompted industry change, right? doctors are already prescribing a lot fewer opioids, in some cases too few opioids. we now have a crisis of underprescribing again in some limited circumstances, where people with cancer aren't getting the treatment they need
