>> well, leigh ann is right. it is a pattern. the committee actually has relatively little recourse. let's be clear. congress cannot prosecute anyone for anything ever. what it can do is make a referral to the department of justice. only the justice department has that executive branch authority to bring prosecutions. and everybody who has so far refused to comply with the subpoena, so as leigh ann mentioned, jeffrey clark, steve bannon and apparently now mark meadows, is going to have the same legal defense that they were relying on advice of counsel. now, that may in the end prove not to be a viable legal defense, but nevertheless, it's something the justice department has to look at carefully. because if they did in good faith rely on the advice of a lawyer saying while this matter is pending in federal court and judges are looking at whether or not president trump still retains any privilege, if they're relying on a lawyer who tells them you don't have to testify while it's being determined, it would be hard to hold them crim

leigh ann, good morning. what challenges does this reconciliation bill face before it comes up for a vote in the house? >> good morning, jose. there's a lot of obstacles left, because the reason this build back better plan was not passed last week is because there was a small group of house moderates who they wanted a complete analysis, a scores, as they call it, of how much the bill cost if they actually pay for it and their impact on the economy. so they signed -- they made a statement saying that they would vote for this legislation if and only if this analysis checks out. but they say that they will do that the week of november 15th, which was next week, but there's a couple of problems with that. the first is that that's a really aggressive timeline for the congressional budget office to come out with their analysis. this was more than a 2,000-page bill and it takes them some time to do this. and still, there has to be a lot of trust within the democratic party, including those moderates who have said th

leigh ann, on the actual vote itself friday night, we did see some democrats half a dozen, members of the squad group, basically voting no on the infrastructure bill. more republicans certainly than i was expecting crossing over to vote yes. how is that playing out politically on the hill? obviously they're gone this week, but what's the political ramifications of the crossover votes or lack thereof? >> well, the republican side is really interesting. these 13 republicans are getting hammered a little bit from some of the more far right members of their party who are calling these 13 republicans rhinos, republicans in name only. and saying they handed president biden a socialist agenda. representative adam kinzinger, one of the republicans who voted for the bill, responded saying he didn't know that infrastructure is equitable to infrastructure. but if you look at that group that was just up on the screen of republicans who did vote for it, well, they have a lot of electoral concerns. a lot of these are moderates. a couple of them are not running for reelection. and so they are doing

and leigh ann caldwell joins me from capitol hill where democrats are still grappling with the other huge part of the president's agenda. take us through what we're expecting to hear from president biden in motor city today. >> reporter: well, craig, when president biden was candidate joe biden, one of the first policy proposals he put out was about installing 500,000 electric vehicle charging stations across the country. he argued at the time this was both a climate policy by helping to reduce fossil fuel emissions but also a jab creator. when biden was the vice president he worked closely with auto manufacturers, with the city of detroit to help revive, get the auto industry off its feet. he's coming here on a big day for gm. as you mentioned, to tout the fact that this infrastructure will help, indeed, not get to the 500,000, but a good stride in that direction. and it's going to be a part of what gm is proposing today to help transition their fleet to all electric vehicles by 2035. if you see behind me, you'll see some of the new gm all electric hummers. i'll remind you the last

leigh ann caldwell, thank you so much for bringing us this.any more on this. >>> the committee for january 6 may come up with more contempt charges. mark meadows and clark have been stonewalling the committee for months now. two of the representatives for that committee had a preview on what to expect. we don't have that sound. we have pete williams and john breznahan. there seems to be a question mark on why not mark meadows also. the two of them did different things. meadows never showed up for his deposition in the first place. clark did, but was not always forthcoming on information. why clark and not meadows. do you have any reporting on this? >> yeah, i've talked to sources on this. there are a couple reasons. one, meadows, there is an executive privilege here that is being litigated. if any of the potential witnesses beyond president trump is covered by this, it would be mark meadows. s he was the white house chief of staff. there is an issue there. like you said, he didn't show up for his subpoena, but he has engaged with the committee

with me now to talk about all of this, nbc news capitol hill correspondent, leigh ann caldwell, and eugene daniels, politico white house reporter and playbook co-author. he's also an nbc msnbc contributor. thanks for being with me. eugene, the national employment rate is at 4.6%. the unemployment rate for african-americans is 7.9%. almost 8%. for hispanics, 5.9%, 6%. a potential 10% rent increase along with a 60% increase in gas prices will hit these groups really hard. is the white house looking at the entire country when trying to figure out how to deal with these uses? >> no, they are. they are constantly talking about equity, as an important aspect of every single thing that they do, right? but when you talk to black voters, black activists, and latino voters, latino activists, they're saying they don't feel that. and that is at the core of a lot of what's happening with this administration right now, is that they have a lot that they could be running on and talking about. they have this higher, the overall unemployment going down, unemployment going down, you have this infrastructure

>> thank you so much for joining us, leigh ann. joining us now, once the house votes on the bipartisan infrastructure bill, as leigh ann was telling us, it would go to the president's desk for his signature. talk to us about how significant this would be. >> it would be incredible. it's building the infrastructure of transportation for united states. and jose, you're probably familiar with this annual report that the engineers put out over year about our crumbling roads and bridges and we see it in so many places throughout the country. so this would be a $1.2 trillion investment in infrastructure. and for growing states like mine, texas, that's a very big deal, because we have increasingly clogged highways, roads that need repair, so this will be very significant for the country. >> so that would be the one thing that could actually get some action on, as soon as maybe today or tomorrow, right? but let's talk about that reconciliation bill. if it's approved in the house, it goes to the senate. where it's no doubt going to face cha

this particular infrastructure bill which one a big success and it's a trillion dollar bill as leigh annhat's a constant argument point on capitol hill. >> it's a real sticking point, ali. there's no doubt about that, and if you take a step back, this is what the debate has been over these individual pieces, that you look at the polling for something like paid family leave, for example, and it's so incredibly popular and has bipartisan support and what you hear senator manchin saying is that he does have concerns that it would essentially be this is what i am told from my sources on both sides of pennsylvania avenue, an entitlement and he's concerned about what it might do ultimately to the deficit and it is also, ali, why some of these things take effect over time, and so what the cbo is going to look at is what is the actual price tag and how long will it take to pay for it and how much will it add to the deficit. the price tag is zero. it's hard to see there is zero, and there's no free lunch, but the question is does it get paid for over time and what does it look like and what's the
