leland vitter is live in washington as they are breaking down that video frame by frame. >> leland? >> it is very tough to watch no matter how many frames of it you look at. james tofoley worked as a freelance journalist for a company called global post. he disappeared while working in a that embattled country since 2012. they posted a gruesome video. they told the associated press the tape is authentic. he appears wearing prison orange, hands bound behind him kneeling next to a black clad militant. he reads what appears to be a prepared anti-american note and then is executed. this video should mark a turning point in u.s. policy. >> this is one of our own. this is someone from our own village from new hampshire. this effects the people and tin the situation room and the ole' office the way it effects you and me. >> foley's family has asked for privacy while they mourn. his mother issued a statement on facebook saying in part we have they have been prouder of our son jim. he gave his life trying to expose the world's suffering the syrian people. we implore the remaining hostages th

leland vitter joins us with what the president has to say as tensions continue to rise. >> absolutely continuing to rise. the president says he is watching these events carefully and closely. he was also careful to say the least in his comments being ferguson yesterday. he said he was watching the events as they unfold but he was watching about the governor's decision to call in the national guard. he pointed out while peaceful protesting is protecting in st. louis continued violence by the protestors is unacceptable. the death of michael brown is a major topic in washington. the department of justice has its own investigation. 40 fbi agents are on the ground in missouri right now canvassing the area there and talking to witnesses and others. they need to let that investigation run its course. >> i have to be careful about not prejudging these events before investigations are completed, because although these are issues of local jurisdiction, the doj works for me and i have to make sure i don't look like i am putting my thumb on the scales one way or the other. >> the criminal investi

leland vitter is her. it doesn't matter if you freeze it or not -- >> it's incredibly chilling to watch. one of the things, stewart's team said he would be racing today and just a couple hours before race time reversed their decision and the nascar decided to sit out obviously because of the department. the trash occurred on a dirt track. sprint car racing, this is amateur video of the event going on there. however, it shows what appears to be the car colliding with a car driven by kevin ward. stewart's car, there's ward's car there. ward gets out of his car and starts walking on the track. he appears to try to confront stewart as he comes around on the next lap. okay. right there you see it. that's when stewart's car collides with ward, throwing him along the track. it was a terrible collision. he was pronounced dead at the hospital. >> there is no evidence in hand or no facts that would spore a criminal charge or support criminal intent on the part of anybody. >> an executive for the racing would not go

leland vitter is live from washington with details on this one. >> tough to walk those words back, kelly. a whole lot of moving parts to this story, put aside for a moment the debate and controversy over the report on alleged torture by the agency. the charge that everyone is talking about now is that members of the cia accessed computers belonging to the senate oversight committee that was preparing that original report. on top of it, as you just heard the cia director john brennan, said it wasn't going on. then he found out that it was going on, had a separate report drawn up on the issue, which showed cleared wrong doing that some say violated the constitution separation of powers. earlier this week, brennan apologized and also set up an accountability review board. now the battle lines have been drawn with the president saying he has faith in his cia director. >> it's clear from the ig report that some very poor judgment was shown in terms of how that was handled. keep in mind, though, john brennan is the person who called for the ig report and he's already stood up a task force to m

i'm leland vitter. >> i'm molly line. that convenience store, the ferguson market, now at the center of the story. police allege 18-year-old michael brown robbed it the same day an officer shot him to death. our mike tobin is at that store. mike? >> reporter: hi, molly. we moved up the straight because something developed out here. what you can see is dramatic change in tactics. in the days leading up to this, the police were nowhere to be seen, avoiding dmon 0 straighters. now you see an ad hoc demonstrations that took to the street and started marching. there are police at the front end of the march protecting them from traffic and police back here on the back end making sure cars don't come up on the scene. they're securing the intersections. if you look back behind me, there are guys with the yellow vests, also directing traffic to protect the demonstrators as they come and go. now, you think about that, strategy leading up to this was no police presence, therefore you can't have clashes with police. and still ferguso
