in san jose, len ramirez, kpix 5. >>> new tonight a report by the city of san francisco is disputing a coroner finding that one of the passengers in the asiana crash was killed by an airport fire truck. cbs news obtained this video showing rescuers pointing to a crash victim on the tarmac. the san mateo county coroner said juan dominguez survived she died because of the crash but the city says the physical trauma of the ejections was the direct cause of death of passengers. and from the city's point of view that includes ye meng yaun. that's in contrast with the coroner's findings in july. >> cause of death of asiana flight passenger ye meng yaun is listed as multiple blunt injuries that are consistent with being run over by a motor vehicle. those injuries she received she was alive at the time. >> obviously, this is very difficult news for us. we're heartbroken. we're in the business of saving lives. everyone is very emotional from this incident. >> the family of ye meng yaun was already filed a claim against the city. the first step in a lawsuit. they say firefighters were poorly t

len ramirez spoke to one of the victims about that terrifying experience. len. >> reporter: that's right, allen. we just talked to the elderly victims. she is in her late 70s, he is in his mid-80s. both remarkably strong people, but as you can imagine, very shaken up by this home invasion robbery this morning at 10:40 a.m. on the 400 block of palo alto avenue a rustic area right next to the san fransesquito creek. they said a man knocked on the door asking directions but it was really three suspects one of them with a gun who forced their way inside the house and told the couple to lay on the floor while they robbed the place. the woman said she made one big mistake. >> and unfortunately i opened the door and the guy came right at me with a gun. and i was pretty petrified. but -- and he stole a bunch of stuff, we're not sure what or how much now. >> did he threaten you with a gun? >> oh, boy. yeah. i -- i kind of thought we were going to get shot. but we didn't. so -- >> reporter: the couple was physically unharmed. the whole thing lasted about 15 minutes. t

kpix 5's len ramirez uncovered some surveillance video that arson investigators are now following up on. len. >> reporter: that's right. arson investigators are reviewing this surveillance video that was taken from a nearby house of this scene right here. this is at east san antonio street and the south 28th street. this happened early this morning. they are looking at that video trying to determine if it is connected to the other suspicious fires that have been happening in san jose over the past two or three days. now, the home surveillance video shows a lone man walking in the direction of where the fire started at 4:26 a.m. just a few minutes before a driver noticed the flames and notified the family living inside by banging on their door. we have blurred out the face of the man because we don't know if he is connected to the incident or just a potential witness. either way, arson investigators are interested in talking to the man, although the fire did little damage. residents of the home were terrified by what could have happened. >> the gentleman all dressed in black with a bea

kpix 5's len ramirez is in san jose with how bay area hospitals are preparing for a surge in those flu patients. lenny. >> reporter: yeah, ken. now, here in the bay area, we tend to see flu seasons come and go, but this is one of the most dramatic developments we have ever seen when it comes to the flu. the regional medical center here in san jose borrowed the triage tent from the san jose fire department to begin treating a dramatic influx of flu patients. now, since last week, 50 to 70 patients have been coming in per day according to doctors presenting the symptoms of the h1n1 virus also known as the swine flu. >>> reporter: >> we wanted to be able to treat these patients quickly and safely and also separate these patients from some of those emergency department patients that don't have flu symptoms. so we have opened this tent and in this tent, we plan to see patients of all ages who present with flu-like symptoms. these are patients who we can hopefully see safely and quickly and discharge home. we'll save the emergency department from patients who might be a little bit sicker and

as our len ramirez reports-- both brothers are charged wh homicide.. len. being. >> san jose state student ended up getting stabbed. both brothers are charged with homicide. len? >> this was san jose's first homicide of 2014. it happened outside a young woman's 21st birthday party at her home right here on sun crest avenue in east san jose. this case is the fourth in san jose and happened early sunday morning. a 22-year-old san jose student, richard, was stabbed and killed, apparently, while trying to break up a fight at the party and spilled out on to the sidewalk. the victim was invited guest of the woman turning 21. the police arrested two brothers who were not invited to the party but were friends of someone who was. 18-year-old ann tong and duck tong were tracked down and both have been charged with murder but they're not giving out specifics as to each brother's role in the killing. i think through independent suspect interviews and then evidence that was gathered at the scene, i think they were confident that we have the individuals that are responsi
