there's not, in my read of judge leon's opinion, a sweeping rejection of the government's theories. economists and antitrust lawyers have known for some time vertical mergers are more often than not co-competitive. they result in benefits for consumers by doing things like reducing costs or combining content and dwricks that allow the -- distribution that allow offers for consumers but we know sometimes they can do the types of things that the government argued. the case for antitrust is, when can we identify those bad instances and separate them out from the good ones? we want them to benefit from the good vertical mergers but enforce and prosecute against the bad ones. i don't read this case as being a referendum on the theories. the government had an opportunity to go in front of judge leon and prove using documents, using economic evidence, all that it could muster to convince the judge that this was one of those instances in which any of the benefits to consumers from the merger were outweighed by cost. they did not do that. i read the opinion is largely about, fact specific fa
