kevin: kevin lewis live in tysons. continuation of a breaking news story.ummer rammed the front end of the silver diner in the busy lunch hour. pinnedded an individual against the front entrance. four people including the driver were taken to the home with injuries of various kinds. we just got a statement from silver diner. i am quoting here. they say, "we understand that a silver diner employee drove through the front of silver diner's tysons restaurant this afternoon. they go on to say we are shocked and saddened incident. we had no indication that the employee would harm himself or others." what we have been told by a number of people including silver diner employees is this was a man who had worked as a cook here. there was some disagreement between him and management. he came here today, the allegation is wreak havoc on the customers and the fellow employees alike. he has been taken to the hospital. one of the four injured. i'm sure police are investigating and charges are pending likely. we'll follow the story. live in daisuke, kevin lewis, abc7 news

the man is 25-year-old kyle lewis. he did take a two-hour nap but now he is back up again talking with negotiators who actually got agitated when he covered his head with a blanket and so they yanked that blanket away from him. sheriff's deputies say they don't want to hurt him. they don't want to hurt themselves by going up there and possibly falling from that height. so deputies have made it clear, they are going to wait him out. so check out this dramatic video from earlier this morning. at 1:20 a.m., lewis was half naked when he flagged down a train, climbed on top and dangled and spun around the electric cable. at one point, he was hanging on it upside-down. by then, crews had already cut power to the train. since it was chilly, about 50 degrees, they threw him a blanket to keep warm. negotiators have been yoursing a cherry picker to get close and talk to him. he is on probation for an unknown prior arrest. case officer and mental health officials are here. deputies defended the decision to give him a blanket. you

live in silver spring, i'm kevin lewis, abc7 news. maureen: thank you. tonight virginia's governor is target of a federal investigation. that investigation led by the department of justice is putting governor terry mcauliffe's campaign under heavy scrutiny. jonathan elias is at the "live desk" with more. jonathan: the f.b.i. and the justice department investigating whether or not some campaign donation to governor mcauliffe violated campaign law according to cnn. the report says he received $120,000 donation from a chinese businessman that drew attention. under election law, foreign nationals are not allowed to donate to state elections. however cnn was told the chinese businessman has the u.s. permanent resident status. spokesperson for the governor tells cnn they have not been notified by investigators and they will cooperate fully if they are contacted. we have reached out to mcauliffe's office a we will let you know what he says. in the newsroom, i'm jonathan elias, back to you. >> he is not living and breathing today. >> what is the judge talking ab

kevin lewis is on the scene for us this afternoon. michelle: kevin, even more startling here, some say this was no accident. kevin: yeah, absolutely. a number of people we talk to say the driver of the hummer was a former employee of the silver diner. police tell us they have been made aware of the allegations as well but haven't confirmed them yet. take a look at the scene here. the burnt remains on the hummer remain in front of the silver diner. that is where it came to rest. we are told -- and take a look help substantiate what i'm saying -- that the hummer ran in the front three times, hitting a man in his 70's in front entryway. we heard he had trauma to lower half of his body. at some point then the hummer started to smoke. and then orange flames were seen emitting and shooting through the roof. customers had to use a knife or some sharp object to cut the seat belt and get the driver out in time. they then dragged his body across the parking lot and pinned him down until police arrived. police then cuffed him, took him to a hosp

to get him down, the sheriff's department brought in a deputy who apparently had a history with lewis. >> one of our transit deputies actually arrested kyle about a month ago, recognized him, had a great rapport. >> well, that rapport paid off. not long after the handshake, the deputy was able to get lewis off the train and bring the standoff to a peaceful resolution. >>> the victim of a car break- in in san francisco helped police arrest three suspects. this were arrested last thursday. police say they broke in a woman's car in the sunset back in march and took off with her camera. when she found her camera in an online post, she contacted police. they tracked down the seller to a home in oakland. that's where they found more than 80 stolen items including rifles, jeans, a tiffany dish and power tools. police are working to identify the owners of those stolen goods. >>> other bay area headlines chopper 5 was overhead as crews worked to right a meals on wheels truck this morning. police tell us that a man and woman carjacked that truck from downtown fremont. they led police on a chase
