well-known east palo alto community activist could soon be set free. san mateo county judge dismissing a murder charge against gregory elarms. police say he killed david lewis outside the hillside shopping center back in june of 2010. the judge says police violated elarms' fifth amendment rights by ignoring his repeated requests for an attorneys. investigators say he eventually confessed to the crime. lewis' mother says she doesn't know why elarms killed her son, that the two were actually childhood friends. >> i would like to see him spend his time in prison. >> elarms is still in jail this morning on an unrelated charge. the san mateo county d.a. will determine whether to appeal the judge's decision. >>> a hotel evacuated overnight. the alarm sounded early this morning at the embassy suites in burlingame. 400 to 500 people had to wait outside in the cold until the gas dissipated. >> handicap rooms where they talk to you, get out of bed, very, very startling. and so i got up thinking it was a prank. and looked around for some hoodlums to stir up and give them some grief. and then i looked outside and saw that there were first responders flashing flashlight

but lewis thinks the fiasco had more to do with wall street's stupidity than corruption. didn't understand these things. >> not well enough. they--they... i mean, there's a wonderful little vignette in the big short about a leading bond trader. he was subprime mortgage bond trader at morgan stanley, a fellow named howie hubler, who manages to lose somewhere between--it's hard to know-- but $7 billion and $12 billion in a matter of six or eight months, more than any single trader has ever lost in the history of wall street, and no one knows his name. >> according to lewis, at the end of 2006 and the beginning of 2007, when the commercial bank j.p. morgan became the first to recognize the danger and fled the subprime market, hubler was gobbling up $16-billion worth of subprime mortgage bonds that would be worthless in nine months. >> he did not understand the forces at work in his own market, and he was supposed to be the smart guy. i mean, what were the dumb guys doing? so i think that it's really clear that the firms themselves did not understand the machine they created. >> what happened to howie hubler? >> he's a

lewis hay, executive chairman of next-era energy, the parent company of florida power and light. here's more of that conversation, beginning with the cost of the repair jobs for power companies in the northeast. >> well, this repair job is going to cost a hugamount of money. i don't think anybody can truly estimate what the cost is going to be. but it will be a lot of money. when we had hurricane wilma it cost us over a half a billion dollars. and this storm is much more extensive than-- expensive than that. the good news is the utilities have the balance sheets and the financial wherewithal to foot the bill. and you know, their vendors aren't going to be sending them bills for quite some time. so they will get the equipment. they will get everything they nd cause t vendors know they will get paid. >> could this wind up as a rate increase in the months or years ahead as they try to pay for some of the storm damage can. they go back to their rates in those states. >> typically in a storm of this sort utilities do go back to their rate commissions. and seek what we call cost recovery. every state does it a little bit differently. but typically if it's a prudently incurred cost to restore power, most ul
