kpix 5's lisa chan live in the newsroom to explain why the d.a.'office is now dropping the charges. >> reporter: anne, the solano county district attorney decided to drop a dui charge against a fairfield man even though she still believes he had drugs in his system. however, blood tests for joseph schwab came back negative for every drug except caffeine. solano county district attorney christian abrams believes there was another drug in his system but didn't show up in the test. toxicology experts say synthetic marijuana, performance-enhancing drugs like steroids, and designer stimulants like bath salts are rarely tested for in a dui blood test. >> so they could test for more drugs? >> absolutely because then we would know what was notice system. >> reporter: -- what was in the system. >> reporter: abrams dropped the charge because she believes they can't proceed without a reasonable doubt. schwab's attorney says he is relieved. >> and when you tell this type of story to somebody, they naturally are not going to believe it. >> schwab is still being

kpix 5's lisa chan live in our newsroom on why these landlords have decided to file suit.> reporter: anne, the council >>> reporter: mountain view voters approved the measure by 53.4% but the rent control ordinance is being challenged and could be stopped. the charter amendment is set to take effect tomorrow but the california apartment association or caa filed a lawsuit challenging the new law and is going to court for a temporary restraining order. the measure limits the annual rent increases to consumer price index percentages 2 to 5% and prohibits evictions without just cause for multi-family rental units built before february 1, 1995. the caa says the charter amendment is unconstitutionally vague, ambiguous and overbroad. the lawsuit also claims the city ordinance preventing possible evictions and rolling back rents to 2015 levels will reduce the amount of rent the landlords can get in the future. caa says the measure deprives property owners of a fair rate of return for their properties and eviction protections within the rent control measure transfer property rights
