kpix 5 reporter lisa chan is live in the newsroom on why the landlords have decided to file suit. lisa >>> reporter: mountain view voters approved the measure by 53.4% but the rent control ordinance is being challenged and could be stopped. the charter amendment is set to take effect tomorrow but the california apartment association or caa filed a lawsuit challenging the new law and is going to court for a temporary restraining order. the measure limits the annual rent increases to consumer price index percentages 2 to 5% and prohibit evictions without just cause for multi-family rental units built before february 1, 1995. the company says the charter amendment is unconstitutionally vague ambiguous and overbroad. the lawsuit also claims the city ordinant preventing possible evictions and rolling back rents to 2015 levels will reduce the a of rent the landlords can get in the future. caa says the measure deprives property owners of a fair rate of return for their properties and eviction protections within the rent control measure transfer property rights from the owners to the rente

kpix 5 reporter lisa chan live in the newsroom to explain why. lisa. >> reporter: anne, the solano county district attorney dropped a dui charge against a fairfield man even though she still believes he had drugs in his system. however, blood tests were negative for every drug except caffeine. solano county district attorney abrams believes there was another drug in his system but it didn't show up in the test. toxicology experts say synthetic marijuana, performance-enhancing drugs like steroids and designer stimulants like bath assaults are rarely tested for in a dui blood test. >> so you could test for more drugs? >> absolutely. because then we would know what was in his system. >> reporter: abrams decided to drop the dui charge because she believes they can't proceed without a reasonable doubt. the defendant's attorney says he is relieved. >> when you tell this type of story to somebody, they naturally are not going to believe it. >> he is still being charged with reckless driving a misdemeanor. abrams received a lot of comments critical of the

lisa chan live at the courthouse in oakland with the new details. lisa. >> reporter: the arraignment for the two men charged with stabbing tyrone griffin to death at a target in hayward on christmas eve is scheduled for 2 p.m. now, according to the district attorney's criminal complaint it says griffin got into a verbal argument with frankie archuleta and his brother jesse. at some point it turned physical and during the physical altercation, the victim grabbed a bottle of wine off the shelf and hit frankie with it. the victim was then stabbed three times in the upper torso and arm. this all happened in front of griffin's 4-year-old son. both suspects left the scene on foot and were later found by police hiding behind a dumpster at a motel 6. as they were taken into custody by police, jesse stated he did it to defend himself. the suspect's sister showed up to the courthouse to support her brothers. >> my brothers are good men. they wouldn't attack somebody for no reason. i mean, i know people are going to judge by the way they look, by what they hear
