lisa argen. lisa. >> all right, kristen, we finally have see a return to the rainy pattern. and it's going to be with us not only for the weekend but into next week, where we see several days of compounding rain that could bring us some issues with the rivers and creeks and some localized flooding. first off, starting out with a pretty warm system, so we're going to see temperatures climb throughout the weekend and high snow levels before the colder part. the second part, or stronger atmospheric river moves in monday night into tuesday. right now, light to moderate rain here up through the delta. otherwise, we've had periods of light rain in the north bay. you can see inverness down along the peninsula and more shower activity from davenport to gilroy and san jose. picking up a little bit of rain. we've seen anywhere from about a third to 4/10 of an inch up in the north bay. the east bay spent a couple of hundredths and you can see the wet roadways there. the golden gate bridge, 51 degrees, san francisco. it is 52, in hayward and half moon bay. and a look out towards sfo, where there's also some clouds and a lot of wind coming in through tomorrow. 49 in napa right now. and a final look outside there you see the gray skies. so the rest of today rain getting steadier for the evening commute. a level two on tap for your saturday. a stronger atmospheric river arrives. and then sunday into next week it's going to get much colder as we see lower snow levels and more rounds of rain. so winds right now up to about 15 miles an hour along the coast. upper elevations 3040 miles an hour. and as this low gets closer, we're going to see stronger winds, heavier rain. so 3:00 today, notice the evening commute is wet. we see a bit of a break into the later evening hours. so overnight some scattered showers. and then look what happens early into saturday saturday morning into the afternoon. we've got gusty winds, heavy downpours a level two system. so good idea to stay inside. and then by late in the day this begins to lift to the north a bit. and that's going to be the trend again on sunday with scattered showers. so adding up the rainfall totals for the rest of the day today. on friday, you can see 2/10 to about a third of an inch for most of the bay. this is friday. then midday saturday, bringing in about three quarters of an inch of rain. you can see lesser amounts to the south. and that final push as we get into late saturday and sunday, bringing us over an inch in san francisco. inch and a half in the north bay. perhaps a half inch. mountain view. so this is just that weak atmospheric river. we've got a stronger one on the way. high snow levels right now with a winter weather advisory with 12 to 18in of snow above 7000ft. so this is for saturday, about a foot of snow, a little bit more than that, maybe two feet in some localized snow resorts. but look what happens as we add this into the rest of the workweek. we're looking at a lot of snow. atmospheric river gets stronger into tomorrow, so keep that in mind. and maybe a rainy day. good day to stay inside. it is going to be a rainy day, but the plans perhaps, hopefully not sending you out on the roadways. and this is a trajectory for the next ten days. talking six inches in the north bay, over two inches in livermore and san jose. the accuweather seven day forecast. rainy and windy for tomorrow. a bit of a break on sunday with scattered showers. next round comes in late monday into tuesday. much colder. a brief break on wednesday. more rain on thursday and it looks like friday. we'll see a break. kristen. >> lisa, thank you so much. now to our other top story. federal investigators from the national transportation safety board just held an update on that deadly midair collision near dc. and here is what we've learned. the black box from the military blackhawk helicopter has been recovered in good condition, and agents are confident they'll be able to recover all the data. they are still mapping out where debris landed in the potomac river, but they say large chunks should be easily recovered. and the reagan national air traffic controllers workers have been interviewed. abc news reporter christiane cordero has the other latest developments today. >> debris sticks out of the icy potomac river. several bodies and evidence are trapped below until recovery. crews work through the elements with heavy machinery to pull them out. divers returning to the wreckage in the water at first light this morning despite heavy rain. >> we're going to be careful. we're going to make sure we don't hurt anybody el

lisa rubin. lisa, there was so much confusion yesterday through the morning while we were on this show and on morning joe. my sources were texting me, do you know what's in this? are we even sure? and then, of course, came the judge's stay last night. this is just a pause, though. walk us through what the judge is saying here. what the judge. >> is saying, essentially, is i don't have enough information, but the claims that the plaintiffs are making are serious enough that she wants to press pause, at least temporarily. >> she entered. >> what's called an. administrative stay. that's to preserve. >> the status quo. >> while she gets. full briefing, both from the department of justice and from the plaintiffs, who represent tens of thousands. >> of. >> nonprofit groups and businesses who are dependent on. federal funding for their very survival and to serve their customers, who are essentially, sometimes some of our nation's most vulnerable citizens. >> yeah. and that was the concern yesterday we were talking about does this impact snap, which is food assistance program? does this impact housing? it's the end of the month. rents are about to be due. there were so many questions. but was the vagueness of this memo the point? look, i will tell you that. >> the vagueness of the memo. yesterday is no more clear to me today, and it sent all sorts of people yesterday into a scramble, whether they were members of the house and senate appropriations. committees who have the power of the purse. whether it's people who are involved in the provision of social. >> services, whether. >> it's journalists. like you and me. and in that scramble. >> yesterday, we were also. >> distracted from. >> other things. >> that the administration was doing. for example, the administration has now fired commissioners from the national labor relations board and the eeoc, the equal opportunity employment commission. those are organizations that are designed also to ensure the protection of important american rights. but nobody was paying attention to those firings, which could presage things to come. and other institutions like the federal elections commission, the federal trade. >> commission. >> these multi-member bodies that have both republicans and democrats built into their structure with longer terms than any one president is in office. those seem to be people who are within the crosshairs of this president in terms of firing them. but instead we were all trying to figure out which programs were and were not included in this. you'll remember yesterday during caroline leavitt, she's the white house press secretary's first briefing. nbc news is peter alexander engaged in a long back and forth with her about. >> whether a particular. >> program like heat, which provides home heating. >> assistance to. >> low income individuals, was included. and she couldn't answer that question. and today, i'm not sure where any clearer on that. >> so i think, yes. >> the ambiguity in. >> part was the point. but there are also. who will also some who will say this. >> is an administration that doesn't care all that much. >> about policy details, and. >> it's possible that they themselves didn't understand fully. >> which. >> programs were and weren't included until they had to walk some of it back yesterday. >> i could see that being true. i saw a list of thousands of programs. it was 800 pages long. i mean, there's a lot that could be included here and that agencies will have to justify very quickly. and this is a convoluted question, but the impoundment act, i think people are going to hear a lot about that. it's central here. what is it and why is it important? oh. >> the empowerment act is difficult to. >> explain in a. >> very short. >> period of. >> time. >> but essentially it says that congress constitutionally has the authority to take money. from the treasury and appropriate it across a variety of different federal priorities. and when the president decides that he's going to move money around or freeze aid, there are certain notifications that have to be given to congress and justifications that have to be given to congress. and none of those things were done here. the president's allies say this wasn't an impoundment. it was merely a pause. congressional appropriators response to that is, are you kidding me? lisa rubin. lisa, i mean, the law is on their side here, right? and it was clear that giuliani was like delaying as long as possible. i just wonder, i'll read the statement from ruby freeman and shaye moss. we have agreed to allow mr. giuliani to retain his property in exchange for compensation and his promise not to ever defame us. do you have a sense do you have a theory about what they might have gotten out of this deal? rudy's keeping all of his properties and his precious world series rings. i think the most important thing, most important word in that statement is compensation. the question is where is it coming from? because this is the same rudy giuliani who post-verdict famously filed for bankruptcy, only to play so many games with the bankruptcy court that he was effectively tossed out of that court. and that's when the women began this new york lawsuit that led to the settlement today. it was because they were trying to enforce that 145 plus million dollar verdict that you talked about earlier. now there's some risk to them. giuliani was appealing that verdict, and it's still on appeal. the new york judge said, no, even though you're appealing it, you still have to turn over your property to them. so it's likely that the women agreed to accept a whole lot less than $145.9 million. but in exchange for the certainty that giuliani would stop appealing the verdict and that they could get on with their lives. okay, so this was make it all like, let's end this prolonged nightmare. give us the money and don't defame us again, but don't defame us again. part seems like, i don't know, risky element for someone like giuliani, who has not exhibited what we would call self-control here. it's definitely a risk element, and it's also something he's already agreed to. this case was originally tried in federal court in washington, d.c, where giuliani already agreed to an injunction against further defaming them. you might have read recently, our viewers might have heard about contempt proceedings against giuliani. one of those contempt proceedings was about the fact that in november, on his radio show, he again defamed them. the two women on two successive nights in november. and that's why they went to seek civil contempt against him. so they already had that agreement. he already violated it. obviously, if they have an agreement through this settlement that he's not going to do it, there probably is something baked into the settlement to give them further compensation or further relief if he violates it. so if he defames him, then he probably has to pay up. but this then gets back to that central question of where did he get the funds? that's a really good question because donald trump earlier in the week tweeted in all caps a single sentence save rudy. there it is. yeah. and apropos of nothing else, right. i mean, this hasn't been like he's this has been in the news, right? and i think many people interpreted this as trump's basically saying, what's happening to rudy giuliani in his view, is unfair. of course, if donald trump had ever paid rudy giuliani for the legal services he rendered in the first place, we might not be in this position. the reason that that verdict came against giuliani was in part because he didn't even get to contest liability in that case. why? because a judge found that he was so obstreperous in his pre-litigation pretrial conduct that it was fair to just decide that he was liable because you couldn't get any discovery from him. he wouldn't come to court. he wouldn't answer questions. the trial that was had was solely on the question of, okay, let's assume that he did it. how much money does he owe them for it? he wasn't even able to contest liability because trump was so stingy. this is one of those circumstances where and trump learns this lesson again and again. he learned it with michael cohen, too. if you just paid the people who did the work for you in the first place, it's a lot easier. you might have spared yourself a lot of pain. well, but it does raise a question if it's, you know, because he's the incoming president. sure. just from an ethics standpoint, it opens up a whole can of worms about like who is trying to do trump a favor by saying saving rudy? lisa rubin. lisa, i'm so glad you're here this morning because there's so many legal ramifications that i want to get to with you. but first, your reaction to the pardon of these january 6th defendants, it was everybody, not just the nonviolent offenders that jd vance and others were trying to use to soften this promise. >> and ali, jd vance wasn't the only person who communicated that. >> that was a message that we heard from multiple people associated with trump world. >> and for weeks, what i was shocked by last night, as you just said, is the breadth of it. >> when trump said that he was going to pardon roughly 1500 people, that still left nearly 100 people. >> if you talk about the full totality of people who have been charged with january 6th crimes. >> at last count, there are 1583 of them. >> i thought maybe they have a different understanding of what constitutes a violent offense than i do. >> and then i looked at the real language of the executive order, and was stunned to find that while there weren't just six commutations, as trump had said from the oval, there were 14. it was a full pardon for anyone committed of any january 6th offense. >> and with respect to anyone who hasn't yet been convicted or tried, there is a directive to the department of justice to immediately dismiss those cases and release those people from detention. >> and then i wonder if we could keep looking at this through the specific january 6th lens, because you turn then to the outgoing president's pardons and those that he issued to members of the select committee, including liz cheney and the chairman, bennie thompson, also staff. but you saw something that links not just the actions that trump took on his pardons, but the preemptive pardons. and then what trump has been saying about what the january 6th committee did or actually didn't do, which is destroy the records of their investigation. can you tie all of this together? because nothing happens in a vacuum. >> yeah. you know, trump had a lot of opportunities to talk yesterday, not just in his inaugural address. >> he obviously talked afterwards in a room off of the capitol rotunda. and then in the footage that you're showing right now in the oval office, it was sort of this discursive back and forth between signing the papers that his white house staff secretary, will schaap, was presenting him with and engaging with members of the press, including our own peter alexander. that's when i realized that he was perseverating on something that he had said earlier in the day that the members of the january 6th committee had destroyed documents. not only is that demonstrably false, but what trump is trying to do here is sell a narrative that these people have committed a crime because it could be a crime to destroy or mutilate or conceal records that are used in a government function. in fact, many january 6th defendants were charged with obstruction of congress or obstruction of government functions. given that what trump is essentially saying is an acceptance of a pardon is an admission of guilt, well, then what does that say about the 1500 people to whom he gave a full pardon, or to whom he decided yesterday whose cases shouldn't go forward? what's good for the goose alley here is good for the gander. i reject wholesale, by the way, that the members of the january 6th committee and their staffs committed any crime. but if trump is the one accepting the narrative that to pardon someone means that they have done something criminal. in fact, that was the excuse he gave for why he didn't pardon himself, then he's going to have to accept that narrative. with respect to all of the january 6th defendants, too. >> yeah. and in terms of the groundwork that he's trying to lay, i remember when republicans were able to take back control of the house, and they asked the committee to preserve its documents so that they could continue working off of them. so certainly that's pretty easy to disprove. i want to pivot to one other thing that trump did yesterday. among a slew of things that he signed was the changes that he's trying to make to birthright citizenship in this in this country. that would be basically changing and amending a constitutional amendment through the office of the president. can you talk about a. can he do that? and b, the way that he's trying to change this rule? well, first of all, the question of can he do that? >> the answer should be no. and in fact, trump knows that because he was asked again in that same oval office signing ceremony as the press was looking on, somebody must have said something to him. to which he responded, well, that might be right, or you might have a good point. he was essentially acknowledging, yeah, this might not be legal, and yet we're going to go ahead and try it anyway. the argument that he is making is that some of those born in the united states are somehow not subject to the jurisdiction of this country, and that both being born here and being subject to the jurisdiction of the country are necessary predicates to birthright citizenship. i think he's wrong, but there will be a long and lengthy legal battle. the trump modus operandi seems to be act first, determine the legality later. and that, as you and i both know, friend is not a sound basis to start a presidency. >> and certainly that's already beginning. it's what's sure to be a lengthy court battle. i think two hours it took for folks to start filing suits about that. and then, of course, trump himself on a personal level, is no stranger to legal woes. but are those now all just over? poof! he's the president again? >> well, ali, you know that when jack smith and his team decided not to go forward with those two federal indictments, they dismissed one case with prejudice and withdrew i'm sorry, without prejudice and withdrew an appeal without prejudice. theoretically, that means that at some point those cases could be revived. but of course, the statutes of limitation may not survive until after the expiration of his presidency. and then, of course, he still could pardon himself at the very expiration of his presidency. so whether or not donald trump will ever be held accountable for the alleged crimes he committed during his first term and thereafter, that remains to be seen. but you can see an emboldened trump approaching trump 2.0, his second presidency, with a feeling that he is immune from criminal prosecution in a broad way. if he didn't have that feeling, i would surmise that he wouldn't have done some of the things that he and his administration did yesterday. >> lisatour de force. thank you for joining us. thank you. and still ahead this morning, we'll go live to cnbc for an early look at what's driving the day on wall street as investors react to donald trump's first day in office. plus, the president signs an executive order delaying the enforcement of that tiktok ban. we'll dig into what that could mean for the popular video sharing app when way too early comes right back. >> breaking news a fast moving disaster in california. >> breaking news former president jimmy carter has died at the age of 100. >> israel and hamas will enter a cease fire, potentially ending 15 months of fighting in gaza. multiple new developments about that terror attack on bourbon street. justin trudeau announcing he intends to step down. >> donald trump is now officially a convicted felon. >> reporting from the nation's >> reporting from the nation's capital, philadelphia, e ( ♪♪) you never want to lose your edge. and the lexus rx completely understands that. lisa rubin. lisa, thanks for coming back for us. this is this case is kind of funny. it's judge kazmarek again. what's going on? >> so you'll remember, katie, as our viewers hopefully will that the supreme court heard this case and over the summer came down with the decision saying that the plaintiffs who originally brought the case sort of vitiate the approval of the abortion medication, didn't have standing to bring that case. many people at the time said, okay, the court has punted, but at some point in time, this issue will likely come back to it. and that's where we find ourselves now, a group of states led by missouri as well as kansas, i believe the third is indiana, are back before judge kazmarek saying, hey, if those guys don't have standing to bring this case, let us intervene, let us take over the case. and they don't want to challenge the original year 2000 approval of medication abortion. what they want to say instead is that some of the extensions that the fda gave, for example, you can now prescribe mifepristone versus, i'm sorry, telehealth, or you can do it at ten weeks versus seven and a half weeks. they say those extensions are what's unlawful here and that they deserve a right to challenge it. the drug manufacturer and the fda, for their part, said, hey, wait a second. what are you doing in a texas court? you have no business being here. judge kazmarek yesterday said we can get to that issue at another point in time. leave to amend or leave to bolster the complaint should be granted liberally. i'm going to give them a chance to come back, change the complaint, just focus it on these issues and add what the state's promise is greater factual support. before i make that determination, the supreme court feel about this? well, i think it will be harder. remember the fifth circuit, which was the second court to take this up, said judge kazmarek was wrong when he said that the year 2000 approval should be vitiated. but he was right in defined, vitiated. i'm sorry he was wrong to say that the fda's approval was unlawful, that the original approval of mifepristone was unlawful. the fifth circuit disagreed with. but they did agree with judge kazmarek that all of the extensions that we were just talking about, prescribing mifepristone via telehealth, extending when into a woman's pregnancy, it could be prescribed from seven and a half weeks to ten weeks. they agreed with him there. the fifth circuit is a court that is one of the most conservative in the nation in terms of appeals courts. however, more often than any other circuit in recent memory, at least in the last couple of years, they have been overturned, including, for example, in the mifepristone case where the court said, hey, wait a second. before we even reach the merits, we have to look at whether these plaintiffs actually had an injury that can be redressed through litigation. and they determined these guys, these doctors over here, they don't. so the states are going to take a second whack at it and try and see if they can't curtail mifepristone entirely, at least, can they really roll back its availability, including through prescription over telehealth? >> all right, lisa our top story today. tiktok. as we said before, an overwhelming number of lawmakers voted to ban it. and they did so because they're worried about national security issues. joining us now is a member of the senate intelligence committee to explain that vote, democratic senator from new york, kristen kristen gillibrand. thank you, senator, for being here. explain from your perspective, having seen intelligence on this why this is a national security issue, the subject of tiktok, and i'm curious about why you believe it is because yesterday i had jim himes on. i know he's in the minority, but you know, he's a member of the gang of eight. and he said that this wasn't an intelligence concern for him, that the data is getting mopped up by all sorts of apps. >> well, my concern is this first, tiktok is an app that lots of people use, and they enjoy it and they love it. >> a lot of people get their news from it. >> a lot of people use it daily and it's fun. >> my young teenagers, kids, they

lisa rubin. and lisa, we listened to the first press conference by the new press secretary who said anything that goes directly to an individual she says will not be frozen. but what did we learn here? >> well, chris, that's certainly. >> not the account that attorney general tish james of new york and. >> several. >> other attorneys. general gave in the press conference from their perspective. a variety of federal programs are at risk, and i'll just name two. attorney general rob bonta of california, for example, was asked during the question and answer session whether fema relief to the residents of his state who have been affected by the los angeles area wildfires could be at risk. and he affirmed. >> yes. >> that in fact, could be at risk. one other program that definitely is at risk is the medicaid program. you have the attorney general from massachusetts, again, during the same press conference saying her state tried to draw down last evening on $40 million in medicaid funding and was unable to because of this omb freeze. these attorney generals will file suit at some point later today. where and when? we don't know. but as attorney general tish james said, their belief is that this is staunchly unconstitutional because the power of appropriations belongs to congress. you also heard her say later in the press conference that the actions that president trump took are arbitrary and capricious. that's lawyer speak for challenging regulations that aren't issued in the ordinary course. they don't give people enough time, for example, to comment or they're not adequately justified by a rationale that would be adequate here. so we're waiting to see what that lawsuit exactly says. in the meantime, chris, we know tish james and others will continue to fight against omb freeze on federal funding to their states and others. >> lisa joining us now is massachusetts democratic senator ed markey, a member of the health committee. he joins me now. let's start there. as you know, i don't have to tell you, senator, medicare medicaid alone covers 72 million people, people of limited means, low income individuals, both adults and children. letitia james said unequivocally, our medicaid reimbursement system is locked. what can you tell us about what's going on in massachusetts and your reaction to it? >> well. >> across the nation. 80% of. >> all people. >> in nursing homes are on medicaid. >> we have a name for those people. >> they're called grandma. >> and grandpa, and 50% of. >> them have alzheimer's. >> when there is. >> an attack. >> on medicaid. >> it goes. >> to our most vulnerable. >> seniors in nursing homes. >> with alzheimer's. >> it also goes. >> to the most vulnerable children. >> in massachusetts. but across the entire country. and when the portals to medicaid aid is frozen, well, that's casting a pall, a s
