police in hammond, indiana, smashed the glaufs a passenger side of lisa mahone's car after they pullr for seatbelt violation. police taser her boyfriend, jamaal jones and pull him out of the vehicle. the video shot by her 14-year-old son, joseph from the back seat has gone viral. ms. mahone is suing hammond and its police department. joining me now, in this primetime exclusive, is jamaal jones, lisa mahones, and her children, janiah and joseph and attorney dana kertz. thank you for joining us. lisa, can you please tell us where you were and how police came to stop you? >> i was on 5th avenue/169th street. i was driving down the street, approaching the expressway. and before i approached the expressway, i noticed the officer had another car on the side of the road. he immediately, ipassed the officer. he immediately got into his car and -- race bead hood behind me. from the left off to the right. i didn't know which way to pull over. i thought oh, my god, he is pulling me over like i just robbed a bank. when he pulled me over, he got out of the car. he asked me for license and insuran

jamal jones was in the passenger seat of a vehicle driven by his partner, lisa mahone, whose two children were in the back. the family was on their way to visit mahone's dying mother in a hospital when police pulled them over because mahone was not wearing her seat belt. the officers ordered jones, who was not driving, to exit the vehicle. but he says he refused out of fear the officers would harm him. police responded by breaking the car's window and tasering jones in his seat. mahone's son captured the incident on video from the backseat. >> i'm not the operator in this vehicle. >> are you going open the door? well, a woman named lisa mahone said the police were right to stop her for driving without a seat belt. she was not buckled in. but when their attention turned to her boyfriend in the passenger seat, things quickly escalated. lisa mahone says she was so scared that hammond, indiana, officers would fire their weapons, she called 911 on them. >> i'm scared to open the door. i was about to open the door but i seen the gun. i'm not opening the door now. >> reporter: her boyfriend jamal jones asked the police to call a lieutenant. >> look at my shoulder [ bleep ]. i got the bar. >> that's a common name. >> reporter: the officer wanted jones to show his i.d. but he had surrendered his driver's license for not paying car insurance. he reached into his bag to get information. the officers repeatedly asked joans to get out of the car. he refuses. >> he refuses to get out of the vehicle. >> mahone's children 14-year-old joseph and 7-year-old jania werehe back seat. joseph was recording the video when things went from bad to worse. >> are you going to open the door. >> you say nobody's going to h

according to the lawsuit, a police officer told lisa mahone she had been pulled over for not wearingbelt and asked her for her idea. she complied and asked to be issued a ticket quickly because she was rushing to the hospital to see her mother before she died. jones asked the passenger for his id. jones told police he had been ticketed for not paying insurance and didn't have a driver's license. so he offered the ticket to the officer. at the point, jones says the officer drew his gun and police asked him to step out of the car. jones refused because, according to the lawsuit, again, he feared the officers would harm him. this is as police are outside her car. her 14-year-old son captured the is dent on the video. you'll hear mahone talking on the tape. you'll see and hear some of what happened, police outside the car, warning, the video is disturbing. >> he appears to be being tazed there. police dispute much of jones' story. they say he refused to offer the ticket and refused to open the window more than the small amount in that video and that his reaching in the backseat put them

lisa mahone was pulled over in hammond, on september 24-th, for not wearing a seatbelt. officers asked her passenger, jones said he didn't have i-ion. d...instead a traffic ticket. police say jones refused officers' orders to get out of the car. they say officers busted the window and used a stun gun because jones was reaching behind him for a possible weapon. >> a 14 year-old is the one who took the hardest because not every time a police car passes our car and you can tell. she is just not right. and the teacher says she is not paying attention in school. it all started from that point. >>mahone's 14 year old daughter recorded this video. hammond police say they have their own video of the incident, but they have not released it. no weapon was found in the car. jones was issued citations for resisting arrest. chicago teachers union president karen lewis remains in the hospital for an undisclosed ailment. the union says lewis went to a doctor because she wasn't feeling well sunday evening. but there have been no updates the union is only saying that she's doing better,

. >> reporter: lisa mahone and her boyfriend, jamal jones, say they were too afraid to get out of thescared for my family and my little sister. she was in the back with me. >> reporter: in a federal lawsuit, the family claims hammond police used excessive force when they broke through the car window, sending broken glass on to joseph and his 7-year-old sister. >> tase me, tase me, tase me. i felt deferenceless that i couldn't even help my family at that time. >> reporter: in a statement, the hammond police department says jones refused to leave the vehicle after approximately 13 minutes had elapsed and upon request by at least three different officers. the statement also said police broke the window, fearing the occupants of the vehicle possessed a weapon and seeing the passenger repeatedly reach towards the rear seats of the vehicle. there were no weapons in the car. jones was charged with failure to aid an officer and resisting law enforcement. joseph, who talked to us with his mother's permission, explained why he thought it was important to record the incident. >> i wanted them to
