so lisa rubin, this was largely symbolic, a symbolic sentencing. but it does cement donald trump as the first convicted felon to become president of the united states. explain judge marchand's decision as he explained it today. >> judge merchan was really titrating. andrea, i think between two polls. one was he tried president trump when he was, as he said today, an ordinary citizen, an ordinary criminal defendant, not entitled to any presidential immunity protections because they didn't exist at the time of the trial. and yet, by the time it came to sentence him, the voters themselves, ordinary citizens, as he said, had made a decision to return donald trump to office and given his status as the president elect, given that he will take office ten days from now. judge marchand felt that the only lawful sentence, and he emphasized that today in court, the only lawful sentence was one of unconditional discharge. that was his way of honoring the jury's verdict, preserving it. it was important to him to do that in honor of the rule of law, and making c

joining me now, lisa rubin. and ken dilanian. and msnbc legal analyst barbara mcquiaid and kimberly atkins. a lot of legal development ins the past hour. he attacked judge jack smith and judge merchan. can you explain the emergency hearing this hour? >> let's start with judge cannon's ruling. she will impose a stay on the release of any special council report. that not only applies to the report itself but to any information contained in that report. in both instances she says jack smith, attorney general, merrick garland and the department of justice employees and agents and those of the special council's office are precluded from sharing either the report or any information th beyond the department of justice itself. that means that for example, when the 11th circuit decides they want to have a crack at this, that those actors would be precluded from sharing with the circuit itself. the information about the report or a draft report. it is not clear to folks like many whether she has jury diction. because earlier this year, she

joining me now, msnbc legal correspondent, lisa rubin.g and what are the chances that they get their way? >> chris, they have made a couple of arguments, and they both have to do with presidential immunity, one of timing, one of substance, the first is the verdict that was reached in this case shouldn't have been reached because it was based in part on evidence for which the president had what he'll call official acts immunity, it came from his presidency, tweets that he issued, the other thing that he says now is that the supreme court's presidential immunity should be extended to presidents elect. it shouldn't just apply to when you are the president but you should be immune even when you're preparing for office and it's on that basis they're looking to stay the sentencing this coming friday. >> we have reported that jail time has been taken off the table. so what are the options for juan merchan. >> juan merchan has said in lieu of incarceration, he wants an unconditional discharge, which is effectively no penalty at all but a way of k

the trump transition from west palm beach, florida and here with me is our legal correspondent lisa rubinare we hearing from crumbs lawyers? >> their argument is because the supreme court's immunity decision over the summer says the president or former president is entitled to resolve their entitlement to immunity before a trial, by necessity, given the trial has already happened he must be entitled to a stay sentencing now. if the supreme court is willing to say you have to resolve whether someone is entitled to immunity before trial doesn't that necessarily mean that if the case is already progressed beyond trial and to appoint there could be sentenced it would also be unlawful to progress to sentencing before resulting immunity? the argument is a different one. he's arguing as a president- elect that transition period is so vital and integral to his service as the future president that the immunity bestowed upon him should also extend to this period right here. >> it seems like the judge would have to move quickly to answer this given sentencing is on friday. >> that's why in the filin

joining me are lisa rubin and kristy greenberg, former federal prosecutor and the united states attorney'sstory of new york. good evening to both of you, thank you for being here with us. lisa, this is one of those things i always turn to you for , you're the first person i think of, and it is that i did not really understand all the words of the judge said. so can you please tell us what they mean? >> essentially what the judge is saying is that presidential immunity and a host of other arguments that donald trump and his lawyers made are not sufficient to overcome the presumption that a convicted defendant will be sentenced. now, as you noted in your opening, donald trump is not going to be sentenced to a sentence that involves any jail time. so why sentence him at all, you and our viewers might be asking? i would submit to you that what judge merchan has in mind here is an opportunity to speak to trump directly, judge to defendant, and have that be part of the record of accountability in this case. kristi knows better than i have, having seen probably hundreds of sentencings in her time

. >> let's bring in the msnbc correspondent, lisa rubin, i asked you about this ruling and you called it stunning, tell me why. >> this is partially because the district attorney's office was aiming for what looked like a middleground as well, but judge merchan was going to try to avoid sentencing donald trump, trump made it clear that he wanted to avoid a sentencing of any kind, and the district attorney's office sort of went above and beyond in this last filing to try to outline for judge merchan an array of options whereby he could preserve the jury's verdict but not sentence trump, so the fact that he has scheduled this sentencing for january 10th is it self stunning. i want to draw your attention to some other facets of this decision because i think one thing that was very persuasive to judge merchan was this is a situation of donald trump's own making in part, i want to read your page seven, he says, the defendant now claims that the court cannot and must not sentence the defendant, the record is clear that he not only consented to that in fact requested the very adjournment tha

nbc's lisa rubin was in the courtroom for us. give us a sense of what it was like in there, lisa, and walk us through judge marchand's decision. >> well, chris, it was totally surreal to be there because many people, me included, anticipated that this day would never come, particularly after donald trump won reelection to the presidency in november with 312 electoral votes. a fact that he reminded judge of when he had the opportunity to speak. but in terms of imposing the sentence of unconditional discharge, which mershone did today, that's a sentence that carries no penalty associated with it whatsoever. no fine, no jail time, not even community service or probation. judge merchan said that, look, the situation presented a number of aggravating factors, including the willfulness of donald trump's conduct and its seriousness, as well as his lack of remorse and his deliberate endangerment of the judge, the prosecutors and their families. but still, he said, the most important factor of all were the constitutional protections that a

joining us now, msnbc legal correspondent lisa rubin. a lot of fighting over this. it did come out. learn, katie? >> i think a lot of what we learned here is jack smith taking us through the decisions that he made. so not just the evidence that he had to support those claims that led him to the conclusion that he would have been able to secure a conviction. but for presidential immunity and trump's reelection, but also telling us these are other charges, for example, that i considered and i ruled out, and here's why. and also, there is a substantial federal interest in our prosecuting him. and one of those interests is making sure that, like people are treated alike, given the more than 1500 people that we have prosecuted for crimes related to january 6th, it was only fair that the person who inspired their crimes, on whose words they relied, was also prosecuted. >> i think it's significant that he believes that even in light of the supreme court decision on immunity, you know, i do and i don't, because if you read the report in particular talking about the pressure campaign on mike

joining me are lisa rubin and christy greenberg. good evening to both of you. ith us. lisa, this is one of those things i always turn to you for. i didn't really understand all the words the judge said so can you tell me what they mean? >> what the judge is saying is presidential immunity and a host of other arguments are not sufficient to overcome a convict been sentenced. it will not involve any jail time so why sentence him at all? i would submit to you that what judge merchan has in mind is an opportunity to speak to trump directly. judge to defendant. and have that be part of the record of accountability in this case. kristi knows better than i have having seen hundreds of sentencings in her time as a prosecutor that moment between a judge and a convicted defendant can be a very powerful one. and the judge seem to be saying i want the record to reflect the gravity of this moment. this is a person found guilty by 12 of his peers and he should have to listen to my telling him why it is i was unwilling to let him go and become president of the united states an

lisa rubin and former federal prosecutor. what can you tell us about the trump team's efforts to try to keep this report from coming public? >> good morning. his lawyers mounted a two- pronged effort here. they've written a letter to attorney general merrick garland urging him not to release the report arguing jack smith is actually not a special counsel, he's in unconstitutionally operating private citizen, that's their argument because they believe he was improperly appointed. they've asked judge eileen cannon and the appeals court but above her, they've asked those courts to block the release of this report and jack smith responded this morning with a filing that says he won't release anything before 10:00 a.m. friday to give the process a chance to play out. it's very unlikely they will be successful in limiting any release on the january 6 portion of the case because that's not even an issue in any court in florida, that's in washington, d.c. whether they are successful in blocking portions of the report that relate to d

assistant manhattan da and our legal analyst catherine christian and here our legal correspondent lisa rubin. it is very short. the stay is denied which doesn't necessarily mean he will be sentenced on friday, does it? >> it does not. in fact, basically there are minutes left in this if we are making a sports analogy with the appellate division where donald trump is now, usually cases are heard by a panel of multiple judges. an emergency motion like this can be heard by a single judge in the problem that donald trump has now in terms of blocking the sentence is the next time we understand a full panel could be together is january 27 which obviously doesn't bring him to a place where he can block the sentencing before he takes office. i predict this move will be the court of appeals and ask for some emergency relief from the court. we don't know exactly what he will do next but i can tell you i feel confident he will do something. >> there is no doubt about that. but talk more about the timing. would it make a difference if it went over into post january 20 when he is president of the united

our lisa rubin was there inside the courthouse as this all unfolded. lisa, what was that like? >> anna, you know, in some respects, this was a disappointing end to the trial in the sense that donald trump was convicted of 34 felony counts and received an unconditional discharge today. but judging by his behavior and his lawyer's behavior today in court, it was a very different donald trump. he understood that even though the unconditional discharge imposes no penalty on him, it definitely had a psychological impact. and he was a more respectful donald trump in court today, as was his lawyer, todd blanche, whose rhetoric in his filings and certainly during the trial had increasingly amped up both against the judge himself and against the prosecutors. that's not to say that they indicated their happiness with what happened today, but that having been said, it was definitely a more sober blanche and trump than i've seen in recent memory. >> and i should remind everybody that we are expecting audio from the courtroom. we will play it in its entirety for you to hear. we just we were
