odin lloyd we're talking about. >> absolutely. we've already seen it when you hear witnesses say i saw flies coming out of his nostrils. that piece of evidence made his mother dry, odin lloyd's mother cry, but jurors are affected when they hear that. prosecution will have to do more of that. it's a circumstantial case. >> you have the defense saying he has no motive. he had his whole life in front of him. aaron hernandez now. he had no motive. that could resonate with a lot of people. >> i'm struggling with that myself. people are talking over dinner and talking about this case. why would he do this? $12.5 million guaranteed. a $40 million contract in total. he had a fiance. a child. you know the patriots are in the super bowl. people really are going to think what is the motive? as a prosecutor you don't have to prove motive. it's not the element of the crime. what juror isn't thinking why would he kill his friend which is what the defense is playing up hard. the defense said it probably over 10 15 times during opening statement.

i then text odin lloyd and say meet with me too.our later you're dead. witnesses saying they heard gunshots. you have a marijuana cigarette with your dna on it and you have ballistics in the rental car with your dna on it and we have surveillance at your house ten minutes later of you holding a gun. it's circumstantial but it's somewhat direct. and at the same time the defense going back to motive why on earth would my client do this? it doesn't make sense, ladies and gentlemen. sloppy investigation focusing on him for celebrity status. it doesn't add up. reasonable doubt. not guilty will say the defense. >> doesn't it depend on aaron hernandez's fiance? if she testifies she got rid of the gun, he's toast. >> in my experience there's nothing more compelling than another witness or person whether it be fiance or otherwise, coming in saying that's the guy that did it or that's the guy that had the gun and even if on the defense side you call that person a liar and prove they were inconsistent and exploit those inconsistencies there's

today several key witnesses are expected to take the stand, including lloyd's mother lloyd's girlfriend. and a criminal scientist at the crime green. joining me by phone, clark panel, he was a jury foreman in the panther trial. clark, i want to start with you, tell me what it was like to sit on a jury in the rae carruth trial? >> well it was very interesting and very enlightening to be able to sit there and listen to all of the different versions of what happened. and then try to sort through it with my fellow jurors to come to the conclusion that we did. >> was it -- i mean did rae carruth's celebrity status affect any of the jurors' decision making? >> i don't think so. we had a mixed jury. i think it was like seven men, five women. all of us were locals. so we knew about the panthers. and we knew about rae carruth, but i don't think that that really played into the decision of anybody. >> what do you expect the jurors are feeling now as they sit through the beginning days of this trial? >> well if they're like me you know lot of us are like this i believe in the system. once you get

lloyd writes nfl, just so you know.missible and not enough proof that lloyd thought that he was going to die. >> if the jury believes that aaron herp dez believe ss he was with oden lloyd before he was killed, it is not a big leap to believe that he was involved in the murder. >> reporter: yet the prosecutors say they have surveillance video showing him get in the car with hernandez and also carlos ortiz and another man who has plead not guilty. that car drives into a industrial park and then later, hernandez back home less than a mile away holding what prosecutors say is the alleged murder weapon but it was never found. >> are there is no murder weapon or a witness that is credible would testify that aaron hernandez did it, but there is no such witness. >> reporter: and the judge blocking any mention that hernandez is indicted for two more murders in boston. the prosecution witness alexander bradley can't say that he is suing hernandez for allegedly shoot ging him in the face a few months before lloyd's murder murder.

you've known lloyd for years, jim.azing, though wasn't he? very comfortable. >> you raised a point. why didn't he come on more given how engaging he is and how the face of goldman was him, except for we didn't know it was? >> and a lot of people were introduced to him with carl levin, asking those inscrutable questions, like what's the sound of one hand clapping? blankfein would just look at him like, you know we're not principals all the time. sometimes we're agents. do you remember that? the guy is like he never had a business course. >> he's very disarming. he's got a great sense of humor. he's also got, i think, a charm about him that didn't come off in front of the senate. i think if he had been on the show more i think people would have said, hey, you know what? he's not a master of the universe as much as he is a guy who came up from nothing, doing well. nobody wants to hear the came up from nothing. all they want to hear is he's doing too well. you made some great points. thank you. >> anyway thanks, jim. see y

odin lloyd is that man. a semiprofessional football player.defense said the two men were close friends, that hernandez had no reason to kill lloyd. jurors heard a different story today from lloyd's girlfriend and also got warning from the judge. susan candiotti joins me with the latest. happens to be aaron hernandez's fiance. what did he say on the stand today? >> reporter: you saw the dynamic of divided loyalties in the courtroom. when shaniya went on the court today, shia nah wasn't even in at all today. shania was used to contradict what the defense was saying in the opening statements when they repeated 40 times aaron and odin lloyd were friends. shaniya said they were the beginning of a friendship, only saw aaron hernandez off and on during the course of the last year when he and she would go over to visit and her sister at aaron's house. >> pictures of odin lloyd's body were also shown in court as well. >> reporter: yeah that brought up a lot of emotion. again, as you can imagine in the courtroom, they used a fire captain to introduce th

hernandez's texts to oden lloyd.e judge barred this key evidence or at least what some thought would be key evidence. oden lloyd's texts to his sister sent minutes before he was killed suggesting that -- he said he was with nfl. any mention of hernandez's involvement in the shooting of three other men that he suspected. and a 2009 photo of hernandez holding a gun. so those things barred. so avery, you first. how significant is what's allowed in thus far and what isn't? >> well the evidence fredricka, is overwhelming here. judge susan garth is right in barring certain prejudiceal evidence. but at the end of the day, the evidence is so strong including motive meaning the position that prosecution is taking is that the motive behind this murder was that oden lloyd disrespected hernandez. and that's going to be part of it. secondly the joint venture theory -- the prosecutors don't need to prove that hernandez pulled the trigger, but rather fredricka, all they have to show is he actively participated in this. so while we

lloyd was dating the sister of hernandez's fiancee.secutors say they think lloyd showed where the bodies were in the case. that's a reason for them to bring up this other murder case in the current case. that has been banned seen as two prejudicial. do you agree with that ruling? >> i do agree with that ruling. i think that evidence in another case that is pending is irrelevant with respect to the charges here. i can see why the defense would make that connection and argue it is relevant. i would see why the judge would agree with the defense side. i'm sorry the judge would agree with the defense side to exclude the evidence. i believe there's sufficient evidence here from my reading to implicate hernandez in these murders. there's evidence of him being the driver of the vehicle that had the other two defendants as well as the victim. arriveing to the place where the victim was ultimately killed. there's also evidence of him in his home holding a firearm that appears to be the murder weapon. that murder weapon was never recovered. ther
