the logan act. in 1798, the united states and france were on the brink of war. the time known as the quasi-war. france was at war with a bunch of neighbors in europe and trying to stop nueutral shippin from sending gifts to enemies. they were attacking the shipping and capture sail areas and war seemed imminent especially because congress and the white house immediate president john adams were controlled by the federalist party which was hostile to france and the democratic party led by thomas jefferson was pro-france and anti war but there was not a lot they could do about it. there was one democratic senator who was a philadelphia doctor named george logan. he was a democratic republican, friend of thomas jefferson personally, a quaker, a pacifist, very pro-french. he thought if he could get to france and meet with france's leaders he might be able to talk them back from the edge and keep his country out of war. george logan was a prominent person. it was no one of the stature that would be needed

logan jenson is a junior at university of wyoming. i met logan when he was at boys state and i spent a day with him. logan is double majoring in physics physics physics and aastronomy the university of wyoming. didn't know that it was possible. i'm not sure it's legal. this is amazing help has taken advantage of almost all wyoming offers as undergraduate. he went fact to the infrared telescope, learning to operate a major scientific facility and acquiring the stills to analyze digital images. as a sophomore he led study the observe -- observatoriy site and will participate in the next solar eclipse, and wyoming is the police for a total eclipse. this is a big deal and i 1/2 my notes, in your own words, make sure everybody knows how valuable this is to tourism. it's a big deal. august 21. he also serves as a counselor to junior high youth tell exxonmobil science camp at uw. done as a junior what many ph.d students would long to do. he is a bushry of uw science initiative. we want to encourage more students like logan to take advantage

michael flynn, how big a hole do you think it is -- not so much the logan act. i know that's out there but we've never seen a successful prosecution of it. but this change in stance where he said no repeatedly about whether or not he discussed russian sanctions with russian officials before he came into office officially, or the president did as well, now he says he cannot recollect whether or not he did. how do you feel about that? >> as the national security adviser, i'm not sure what all the issues are. general flynn, it's his job to advise the president on national security matters. he's well versed in them. what may have happened in a private phone conversation, while i don't know what it is, i wouldn't personally have concerns one way or the other. it wasn't in a policy making role when that phone call took place. >> it wasn't just one phone call. we've heard from multiple sources now and we know the fbi is looking at it as well, that there were multiple communications. and if, in fact, there was discussion about the sanctions that lent some type of credib

in fact timing is what's the most important, considering the logan act. the fact that you're talking about him doing it before he was in an official capacity on behalf of the united states is very key. the logan act essentially says, listening, we do not want private citizens dipping their fingers into foreign policy or trying to undermine the administration in any way. but largely it's been used as a political weapon. in fact no one has ever been convicted under the logan act mostly because it's unclear whether or not or who can give the authority to act on behalf of the united states. it's been wielded many times, pelosi was accused of using it. you had senator cotton being accused of violating the logan act when he wrote the letter to iran about the nuclear uranium compound issues. boehner was accused of violating it, talking about inviting netanyahu to speak. this is a political weapon that's often used, it's rarely used as an actual criminal act. in fact we have no direction as to how to actually enforce this law. it's a little bit murky. >> it may n

we heard it mentioned just then, the logan act, if he discussed the lifting of u.s. the ambassador to the u.s., before president trump took office. what is your response to that? was there any crime committed here at all, do you think? >> no. the logan act was passed in 1799. in over 200 years, nobody has ever been prosecuted for it. if anybody looked at the logan act, they would realize it's probably unconstitutional. we had a number of people who weren't elected that take to foreign diplomats. president obama, when he was a candidate, spoke to afghanistan leaders, palestinian leaders, flew to germany. spoke to merkel. all these things he was doing as not even president-elect, as candidate for the office. there's no way he could be go after someone under the statute. nobody has bothered to prosecute in 200 years. only the most partisan of advocates, would suggest that some statute has been violated. this would be a case of first impression, on a law that appears to be unconstitutional on its face. i don't see it happening. >> you worked in the justice department som

the logan act basically is a provision that says that if you are a u.s. citizen, you cannot go negotiate private deals with foreign governments particularly ones with whom we have an antagonistic relationship. this looks like a textbook violation of the logan act. >> politically though, how bad is this for this administration to have sean spicer, white house spokesman, vp mike pence and reince priebus chief of staff come out and say he never said it. he never discussed sanctions. are they going to pay a price in congress? are they going to pay a price in terms of trust with the american people? >> it's horrible for them obviously. the question of the price they're going to pay is different. first of all, trump voters are pro-russia as we've seen. they aren't alarmed by this in the way you would normally expect. i think, if in fact, the problem goes back to flynn and not pence or staff, i can imagine them tossing them under the bus over this. the question of the transcripts which "the new york times" reported do exist will put to the test his words. was it

there's questions whether this was a violation of the logan act, never enforced before, i can point to other violations in the past and real concern about general flynn's contacts with russia, even prior to his involvement in the administration, and i think this was -- look, general flynn is an honorable guy. he did extremely well in iraq and afghanistan, fought hard on behalf of the united states. this is a problem, and i think he became a distraction for the president, whether the president asked him or he made the decision is irrelevant. he did the right thing by steppingside and we need to move on. we need to hold the russians accountable to their bad actions in the world, and hopefully we can do that. >> what is still left unclear is whether he was freelancing, directed by president trump or others, steve bannon, we don't know, and whether he debriefed the president and others about his conversations with the russian ambassador. >> yes, it is unclear and i don't have answers for that. it's something i hope the administration would come forward with. again i think even the act of i

the logan act has beenin good question. the logan act has been in place since 1799. contacts with foreign governments when they are not in power. it basically means we have only one president and one administration at a time. in this case, i think it's probably, perhaps, a letter of the law violation but not a spirit of the law violation. we don't know until the transcripts of the phone call that he held with the russian ambassador are widely and publicly released. i don't think this is as much a legal problem. i do think this is... you need someone as national security adviser who has the trust of the president, who can manage the national security council. there are big challenges facing the world and the us right now, and we need someone credible, honest and who has the trust of the president and vice president. lieutenant general flynn had lost that trust. the whole point of this conversation between mr flynn and the russian envoy was to discuss sanctions. it was not a side issue, it was the main point of the conversation. does that suggest to you that other peop

not a single person has been prosecuted under the logan act. primarily because everyone recognizes it is patently unconstitutional. >> jon: the president said he wants the justice department to look into these leaks. first of all, is that the best route to take and a second, will they find anything? >> he can't direct the general to do anything, it's just a referral. >> jon: he cannot? >> no, he cannot make the general do anything. the president was right, it's a crime however lead to this. the statute is very clear, if you leak classified information to an unauthorized source, that is a felony punishable. the problem is, the source may have come, one or more of the sources may have come from the doj itself. as a holdover from the obama administration, because a reporter said officials who were in senior positions at the time of the call, that was december. you're talking about people who are serving in the obama administration. you may still be there, can the doj properly investigate itself? maybe a special prosecutor should be appointed. >> j
