at lois lerner, and one of the hearings earlier, that says that the irs probe also includes lois lerner e-mails. looking at some erased e-mails on her blackberry, what do you know about that? >> they're looking at the computer crash that the irs says happened in this learner in 2000 11 am a and they have provided e-mail showing or contacting computer services and seeking help to fix her computer. that nearly two years of e-mails are gone -- they don't have backup tapes. people are looking into it. the treasury inspector general has her blackberry, at the irs said the blackberry will only have e-mails that were in outlook, on her main computer. it is ongoing. and theentioned, headline reflects this, republicans are pushing for a special counsel. withhat they are not happy the status of the investigation, calling on justice to appoint a special counsel. how likely is that? >> i think that is unlikely. attorney general holder has said he does not think that this case merits a special counsel. it is unclear whether these alleged conflicts of interest would push it to that level. one of the

four days later, they tell the world, we've lost lois lerner e-mails. when they knew that, according to plchl koskinen's testimony in questioning from me that he knew in april they couldn't get ms. lerner's e-mails. so they waited two months, and then when they decided to tell us four days after, on a friday, four days after we knew there were e-mails we were getting from justice that we weren't getting from the internal revenue service. all i'm saying is that timing is pretty suspect, particularly in light of the fact all the other things we've heard from the irs. one computer crash, seven, eight, maybe up to 20. we can confirm there were no backup tapes available. we can confirm that. there may be one available. when you look at the timeline, it looks pretty suspect. all i'm saying is i'm not sure they were going to tell us. >> chairman, will the chairman yield? mr. chairman, you've -- this has been very interesting because, one member on wyour side, the gentleman, i don't know his name, said to man was under investigation, and i heard -- i was in that

first, we were promised that the irs would produce all of lois lerner's e-mails. en we learn that some of miss lerner's e-mails had been destroyed and there was no way he could produce all the e-mails to congress. second, we were told the irs had confirmed all the backup tapes with the e-mails had been destroyed. then we learned last week from airs attorney thomas cane that a backup tape may in fact exist. third, we were told there was one hard drive crash, lois lerner's. then the ways and means committee disclosed there were seven or eight total crashes and now we learn from mr. cane there may be as many as 20. think about this. the irs has identified 83 custodians of documents and information. the irs has identified these people associated with this targeting of conservative groups, and now almost a fourth of them may have had hard drive crashes. unbelievable. fourth, we were told the irs found out in april of 2014 that miss lerner's e-mails were lost. we learned from mr. cane that irs knew on february 4th, 2014, about the hard drive crash and that it found out j

it centers on the missing lois lerner emails. if you remember the irs says it went to unprecedented lengths to try to retrieve two years worth of emails from lois lerner that were supposedly lost in a computer crash. well now there is word from judicial watch, the government watchdog organization, that the government actually has a backup system. the watchdog group says a department of justice attorney admits it and said so on friday but the doj says there is no backup system and this is just the email retention policy the irs has in place. joining us now, ellison barber, staff writer for the "washington free beacon." so, judicial watch is saying they were told on friday, by a department of justice attorney that there is definitely a backup system that should have recorded lois lerner's missing emails. do we know in fact that that actually exists? >> well, theoretically we do know they are supposed to. according to the federal records act we know government agencies are supposed to be backing up their emails. what the irs said in
