in fact i chaired the commission to the los angeles city charter and we put that in the late '90s andndependent commission because otherwise the political party that controls the legislature draws the districts to maximize into computer programs are sufficiently sophisticated and there can be an enormous variance to the amount of the political party favored in the state and the number of districts they are able to control. i would favor the commission. arizona legislators have a challenge on this and says article one of the constitution says that the legislature of the states shall set the time, place and manner and they say therefore you can't get that to the district commission. the united states court of appeals in the circuit upheld the arizona law and is at the legislature refers to the political process of the state it's not just the legislature itself but besides that look at the language in the constitution. it is the legislation but the time, place and manner to me that it doesn't say anything about the districting. when i first heard of this case i thought the challenge was
