a local man says that is the treatment he suffered at the hands of a lowden county sheriffs deputy and the whole thing is caught on tape. as our ken molestina reports, that man is now fighting back. >> reporter: take a good look at this police video posted on youtube. the man in the dark shirt in front of the officer with his hands up is carlos garcia. the lowden county deputy running into the shot is terry daniel. >> terry daniel runs up to carlos, never sees him coming, has his back to him and pounds him on the head and drops carlos to the ground. >> victor glassberg is representing garcia. they claim deputy daniel abused his power back in november last year when he viciously knocked garcia to the ground leaving him with permanent injuries. garcia, his friends and family were leaving a bar in sterling getting into a cab when this all began. his defense team says there has yet to be any explanation as to why deputy daniel felt the need to do this. >> we do know that what happened that night did not justify his use of violence against mr. garcia. >> this side by side come par it son sh
