(applause) >> okay. we have greetings now in the program. i think we will go ahead and move forward with the greetings from the supervisors and we will then be followed by city administrator kelly will introduce the mayor upon the mayor's arrival. so, with that i'd like to ask supervisor cohen if you would come and extend greetings, please. >> thank you. amen, good morning, everyone. good afternoon. how are you? i have to say you look beautiful to look out and see so much red. this is an exciting time for all of us here in san francisco. and as i stand before you on this day, we celebrate black history month in san francisco. this is a day on which we acknowledge the being at the crossroads of equality and freedom. celebrating the emancipation proclamation as well as the march on washington, as well as the 100th birthday of our dear sister rosa parks.

therefore the library asks that the ethics commission find that the city librarian luis herrera did not violate the sunshine ordinance as to the allegations and also to have the library commission secretary sue blackman in case you have further questions, thank you. >> mr. hartz, rebuttal? >> commissioners, this is the same argument that he has been presenting for the last three years. the city attorney says we can do it. and the bottom line is why do they want to? why were they so determined forcing me to go to the sunshine ordinance task force on three separate occasions delaying, delaying sending miss blackman to answer when mr. herrera was the one calling the shots. and mr. herrera did not have the integrity to show up and say to the task force here is why i am doing this. i think that speaks volumes. i think that it speaks to the fact that if i am doing something which i probably know is questionable, i certainly don't want to go before a body who might ask me why are you doing this? i have repeatedly and so have other members of the public asked mr. herrera and the library commiss

luis herrera has been found in violation of the order of the sunshine order task force to produce the records and has withheld public records. and the reason for that is very simple. the library commission nor the librarian can account for $50 million. and yet they have repeat petedly come before the public and said what a wonderful job this group did. * at the same time mr. herrera himself was accepting 25 to $3,000 a month from the friends for reimburse many of expenses that would otherwise have to come out of his pocket. if that isn't a conflict of interest, what is? pay attention to mr. chafee. he's been coming here for years and you've ignored him long enough.
