joining me is luke russert. the numbers are as many as 35. what are we hearing from democrats? >> well, there's a lot of democrats, tamron as you know very well that come from swing districts places where the nra has a lot of influence especially in rural areas but also in sort of suburban slightly rural areas. the nra is the most powerful special interest group in this country. and there's a lot of democrats from swing districts that do not get on the wrong side of the nra and will be forced to hold eric holder in contempt tomorrow afternoon. this is something we've heard numbers from 25 to 35. the reason why is because darrell issa has this theory that the reason why the white house has been slow to act on the fast and furious was that there was going to be a national swell, if you will, for gun control perhaps bring back the assault weapons ban because of what was going on between the mexican and american border about the gun flow there.

joining me now is luke russert.st, break down what happened at this meeting and then let's talk about defek fors from the left to agree with the right. >> absolutely. yesterday afternoon people from john boehner's office, darryl issa's office met to avoid this contempt vote scheduled for tomorrow. the white house showed the republicans pages of the documents that they had wanted to see. they had requested hundreds and thousands. they walked away, the republicans did, saying those aren't enough documents. we want to see all of them and they refused and now later on today they will set up a contempt vote against eric holder. there will be two votes a criminal contemp vote and a civil contempt vote and the difference between that is a criminal contempt vote would be then asked the u.s. attorney here based in d.c. to prosecute holder. that attorney won't do t the other contempt vote would be to have a court look and make him operate the investigation. both are unlikely to happen, thomas. >> luke russert reporting from w

joining me now is luke russert. luke, it was interesting. huh boehner joining darrell issa at the white house and not with t the -- >> it did not get very far. there was a meeting last afternoon at the white house between representatives from darrell iaas and speaker boehner's office and neighbors was there. a man you know well. they said look, let's do away with the contempt and show you all the do you means you need to know. here's a 30-page sampling of the ones related and the folks from boehner's office and iss a's office said no. you need to show us more. the white house said no, not until you take the contempt charge off the table. from where we stand, the house rules committee will meet and formulate the rules of the debate for the motion tomorrow. there is going to be a vote on criminal contempt and a vote on civil contempt. what's the difference between the two? criminal contempt will refer to the attorney general here in d.c. the district attorney who will say we can't prosecute the boss. that will be nothing. the civil attempt wil

we have luke russert on the hill. thanks for coming back. >> so, luke, what's going on?this vote to happen? >> right now we're in a series of procedural votes and we're having a debate from both sides on the floor. but by about 5:30 p.m., you will have had two votes that are occurring in the house. you will have a vote to hold eric holder in criminal contempt of congress, and a vote to hold eric holder in civil contempt of congress. the civil one essentially the house if they wanted to could hire their own lawyer, their own council and pursue this case into various courts that would then try to instruct mr. holder to cooperate with the congressional investigation. the problem with that is that courts move slowly and the house's authority on this expires come january when a new congress is voted in. what we're really seeing here is a political show. the red meat of the -- they want eric holder's head, so they're going to get it today out of the house, but a lot of democrats say, and gop leaders admit that the timing is not -- it will not be the lead story, which it would

. >> nbc's luke russert joins me now, give us the lay of the land, as it stands right now, in the next wait, what happens. >> in the next few hours, tamron, you're going to see two votes, you're going to see a vote that would hold in criminal contempt and the vote to hold him in civil contempt. the vote in criminal contempt would hold him to the justice department to bring up charges against mr. holder. that's unlikely to happen, the justice department usually does not do that, considering the attorney general is not at the top. the civil contempt charge would be the house's ability to tryç and hire outside council and take this to t court and say eric holder is not participating in this investigation. here's outside court, please force eric holder to participate in i.c.e.'s investigation. this contempt charge against eric holder only lasts until about january 2013 when the congress ends, tamron, so it's anyone's guest as to what this does. there's not a lot of teeth here in my conversations with legal analysts. it gives house republicans this red meat issue they want that eric holder

the loudmouth luke russert on capitol hill. cnic. the house has followed the senate in passing a transportation bill that could create over 3 million jobs. luke, what happened? >> how about that? >> unbelievable! >> america's birthday coming up on wednesday. a week before republicans and democrats said hey, lady liberty and uncle sam, here is a wonderful birthday present, a jobs bill. that's both sides agree it is. has to do with the nation's highways and transportation projects. essentially republicans and democrats got about half of what they wanted. republicans were not able to get the keystone pipeline and transportation bill but they were able to get a permitting process of less environmental red tape. democrats weren't able to get everything they wanted. but they were able to sort of get keystone away from it and also get the bill which they say will make things steady and in place in terms of the money going out until 2013. so people will have an incentive to hire workers to do the highway projects they need to happen. >>

i'm luke russert filling in for chuck todd. tomorrow the president will head to ohio for a speech. it's the president's first campaign event that's neither a rally nor a fund-raiser. in an attempt to turn the page for two bad weeks for the white house. the president's economic message isn't selling. the president attacked romney's economic plans saying they're just like failed republican economic policies of the past. >> i love listening to these guys give us lectures about debt and deficits. i inherited a trillion dollar deficit it's like somebody goes on a restaurant and orders a big steak dinner, martini, all that stuff and then just as you're sitting down, they leave. and accuse you of running up the tab. >> but with the economy stalling, team romney is displaying impressive message discipline. the president tries to point again to the republicans' past. >> the president, as you know, said last week that the private sector is doing fine, and he is so out of touch with what's happening across america. >> when i hear governor romney say his prief years in the private sector gives

joining me now are our capitol hill correspondents, kelly o'donnell, luke russert, kelly, the status of these talks. are there likely to be more talks to try to avoid this or -- >> there are no indications yet. no indications yet. but because there is still time, more than 24 hours, that leaves open the door could there be more negotiating and while there is sort of a partisan aspect to this where people are talking about kind of the public face of it, there has also been a calmer behind the scenes effort to try to resolve this. it hasn't made any real ground up yet but it's still possible. so we do have time but no indications that it will happen. part of what is really at risk here is who is going to blink, and the attorney general has a difficult position in that he has in the past given some false information to congress that was later corrected. that's really the heart of this contempt of congress citation, the larger investigation about what happened in the fast and furious operation is also part of an ongoing thing. but the contempt is really about that. and that's at the hear
