now police say it happened at a shopping center on lundy avenue. marla tellez is live at the scene this morning. there are bizarre circumstances in this shooting? >> reporter: brent, good morning. yeah, this is not your typical homicide investigation. i'll explain the bizarre elements in just a moment. first, let me show you where we are. we are in the king barry center at the intersection of bariesa and lundy. when we arrived this morning police had the entire place taped off. now the 7-11 and donut shop are open here for business. homicide investigators are focusing their investigation near the lundy liquors with the man was shot. they responded to the shooting about 9:10 last night. when they got here there was no victim and no suspect. this is where the bizarre elements come into play. then about 9:20, about ten minutes later, a man checked himself into a hospital with gunshot wounds. police say that man was the one shot here and drove himself to the hospital. he ended up dying at that hospital early this morning about 1:15. it was about four h

police say he was shot sometime around 9:00 last night near lundy avenue and berryessa road. investigators trying to determine a motive and how the victim made it to the hospital, where he died. the man is believed to be in his 20s. >>> berkeley high school taking action after two incidents involving guns on campus tuesday. no one was hurt when a shot was fired in a campus restroom and another student was found with an unloaded gun. three students in all were arrested. the school will have extra safety officers on campus now and there will be meetings this week with students and faculty about gun safety. and then two more meetings next week. >>> it is 4:40. a dramatic rescue going on right now in texas. we have some live pictures here from fort worth, texas. it's a tanker truck hanging off the edge of a freeway ramp in fort worth. rescue teams got the drive out safely but there are still two people inside a small car that's pinned under the truck. crews are trying to get them out right now. the truck is a water tanker and is empty. >> that's good. good news. >>> it is 4:40. a

. >> reporter: and there's a 13th homicide of 2011 monday night on lundy avenue. friends drove the 20-year-old victim to the hospital where he died. >> god bless, he pass away. i never seen any incident happening over here. >> reporter: we've got 13 homicides, we're on pace to perhaps double last year's amount. what's going on out there? >> there's no doubt, even if we had 10,000 officers on the street, that may or may not prevent a homicide, so i don't want to paint that picture. >> reporter: but during this year's taping of the public affairs show, the chief said people will feel the impact of layoffs and demotions. >> anytime you reduce staff at the numbers we're talking about, you'll inevitably see a rise in crime rates and response times. >> reporter: and that could leave crooks out on the streets that the sergeant might otherwise put in cuffs. >> we have to protect those who can't protect themselves, and we need to put bad guys in jail so that those people are protected, the citizens are safe. >> reporter: and at this rate, san jose is on pace for 52 homicid
