a lot today in court and maybe people have read about it in the newspaper a little bit, is the lynn stewartase. that was a case where there was a special master appointed but it was a very different case and the government today spent a lot of time distinguishing in court why the lynn stewart case is different. not only in that case was the lawyer being criminally prosecuted but she had a lot of real criminal clients which mr. cohen doesn't have, who were criminal defendants in cases before, pending in the southern district of new york. so there was a lot of potential for real attorney/client privilege issues to arise. so i'm summarizing it, but there were a lot of valid reasons to have a special master in that, to review all the materials in the first instance. that's not the case here. the government made that case, and it seems like the judge has agreed with that in large part because she seems to be denying the request in the first instance for the defense to review the materials. she has not said no to a special master although my sense is that she's looking at it in kind of a combinat

like she's not going to have a special master in the way it was in the lynn stewart case where the specialaster reviews everything in the first instance but more she's going to let the party start doing the review, the filter team and the defense, kind of simultaneously on a rolling basis. it seems like she said the government has to turn over the materials they've taken to the defense so they can start reviewing them and they can start making their claims, if you will, or motions is usually the way it's done. but here they would sort of -- this body of documents is privileged. and then maybe go to a special master to say okay, we have a dispute over these documents, these set of -- >> i see. as a neutral party at that point the special master could be not brought in when there's a point of contention. >> correct. and judges always want parties to try to work things out as much as they can between or amongst themselves. doesn't seem like there's a lot of possibility of that here, but maybe, you know, by having the parties starting to do that on their own and then bringing the really disput

they say we don't need a special master here -- in the case of lynn stewart, a criminal defense lawyer in new york who was charged with terrorism related type charms. and she shared office space with other attorneys that were also criminal defense attorneys. that screams special master. that screams that you need someone on the outside because there is so many potential work con flecks. >> michael cohen, that doesn't apply to any of these. that was part of the argument. he is not a full time practicing attorney. >> the main argument is that the materials that we're looking for are not related to a real legal practice here. they said in open court we're looking at his business dealings. there is likely clear cut privilege and nonprivilege decisions to make here. she is a very confident no nonsense judge. i think she recognizes that if she goes that way did is about a compromise and reassuring the american pup tlak it is being treated down the middle. >> perception, but more concern i have to say it is more about the perception of fairness. essentially the president is going to get bette

there is attorney-client privilege information that should not be looked at, used in the past with lynne stewart, who was an attorney who was convicted of putting out a press release the government said that was revealing -- allowing her client to communicate with his followers. she hasn't decided yet. she said that is one thing she is going to consider. she asked for names from both sides about who they think would be appropriate. remember, a big part of the investigation into cohen is taxised to pertain to his medallion business. i could see her saying, ok, let's start by searching for all of the taxi medallion stuff and that can be handed over immediately. and then anything that involves the name "trump," for hats, will have a special master look at that. i think she hasn't decided yet. she spoke her strongly in favor of the integrity of southern district prosecutors, so she may not appoint one at all, but she is going to find some solution that takes care of privileged medication. but again, huge trunk of this is not privileged at all and no one is really claiming it is false of amy: the dai
