here is macy's. on the front pages of not just financial newspapers, but everywhere, and that is the partner charged with insider trading, we talked about it yesterday, now the trader is free on $150,000 bond. we're on top of all the latest developments. los angeles federal judge freed the partner that has been fired, ordered him to turn over his passport. they are worried he might flee. there you go, london has now both criminal and civil charges against him for allegedly passing l.a. area jeweler nonpublic inside public information about five of the clients including herbalife, sketchers. up until recently people just thought it was sketchers and the other name people were talking about, they felt it was a situation with a couple of takeovers. making payments to london in various forms, envelopes stuffed with hundred dollar bills, expensive concert tickets, one of them to bruce springsteen concert, a rolex read got caught because of a suspicious transaction on his fidelity account, they froze the a

macy's is up 1%, but macy's seeks a temporary restraining order against jcpenney and martha stewart living block the sale of goods pending appeal of earlier ruling. now, the earlier ruling said, okay, jcpenney, guess what? you can sell martha stewart products that are nonbranded, that don't have her name on but that she actually designed. that was a win last week for jcpenney. well, now macy's says, hold on, we're going to issue a restraining order, we're going to seek one at least, and this is just not fair. we have the deal for branded martha stewart living products. remember the pitcher? there was the acrylic pitcher, very similar the one that jcpenney's is selling, but it's a lot cheaper. so macy's puts a restrainer order against selling pieces that jcpenney has it in a holding area. charlie's bored by this story. >> reporter: i don't think it's a story. liz: well, i just think it's interesting that you've got macy's, a huge retailer, issuing -- seeking a restraining order? >> reporter: that does happen. liz: you don't care. when martha stewart entered into an exclusive contract with macy's, exclusive, meaning only macy's willher products. tracy: right. >> did she have the right it enter into another contract with jcpenney. if she did not, then that contract is void and the question then becomes, what comes of the martha stewart products that j.c. penny already purchased from her and has, they can't sell them? tracy: right. >> if the court rules this way, that macy's, prevails, the court is confronted with a difficult question, which is, called, waste. the court can not order the destruction and waste of something of value. so what does the court do with it, since it can't be sold? that is what the judge will have to come up with, if the "new york post" prediction that macy's is going to win is correct and it is a sound prediction since the contract with macy's was prior in time, though i haven't read it no doubt prohibited her from selling to somebody else. tracy: right. adam: would jcpenney have any recourse against martha stewart? >> absolutely. adam, absolutely. great question. she ought to have known t

macy's really gaining a lot of market share. do we see that trade now because there's a belief there can be recoup of market share lost under ron johnson. >> what people don't understand in this pop is obviously the shorts that are starting to cover. this isn't something that's fixed because ron johnson is gone. the other interesting thing, you look at the weekly option expiring on friday, they were behind 17 strike calls today. trading 3,000 against open interest less than triple digits. so something was out there today that folks were starred starting to wonder when and if j.c. penney would move to the upside. did somebody know about him leaving before this came out? >> that's what you would think. >> there was a report out there that there was private equity. that could be a little bit of it too. it could be the combination of the two. johnson out, private equity coming in splits up the assets that are left. that's what you do with the company. >> let's bring in courtney who spoke to ron johnson at the beginning of february.

macy's looks fine. it's got double digit earnings growth expected over the next five years annually. stock chart looks good. it's absolutely fine. but i think jc penney is more interesting here. jc penney reminds me of an emergency room patient who's got a severe case of appendicitis. the appendix has ruptured. one of two things is going to happen. they're either going to die waiting for treatment or somebody's going to go in, operate, take out the appendix and the patient will eventually get on its way and return to life. ron johnson, ceo of jc penney, is that ruptured appendix right now. dr. bill akman in my opinion is going to go in and remove him. bill akman has been very clear about his support for ron johnson until last friday when he said that johnson's tenure has been, quote, very close to a disaster. he used the word "disaster." if my boss used the word disaster i'd be looking for a new job pretty quickly, updating my resume. >> ron johnson as ruptured appendix. i've not heard that one yet. car

the judge dismissed macy's claim that mslo violated the contract with macy's by showing that contractto show it to them because j.c.penney was interested in them. so the macy's lawyer is upset about the ruling. he looks forward to today's argument. whether they violated the contract with macy's when he entered into that contract by designing certain product categories. they are going to appeal the dismissal yesterday. right now martha stewart's lawyers are saying macy's did not show they reached a burden of proof by designing products for j.c. penney and are not labelled in martha's name. if the judge dismissed this claim, it will necessarily take the umph out of macy's injunction we expect them to file some time today or tomorrow to broaden the scope of what they're asking the judge to keep jcpenney from selling on the shelf. we'll keep you updated when we know more. simon, back to you. >> thank you very much, courtney. ahead in the program. it's been all the rage lately. stay with us on cnbc. ♪ (train horn) vo: wherever our trains go, the economy comes to life. norfolk southern. one

well, jcpenney is not confirming that mike ullman has or has not had any discussion with macy's about the settlement, nor is jcpenney confirming the report that three executives have left the company, but news did just happen inside the courtroom behind me. judge jeffrey owing basically denied a dismissal notion. they say macy's lawyers have met the burden of proof necessary on the claim that martin luther living violated its contract with macy's by designing products for jcpenney in the categories in question. we're talking about the ones that are not labelled with martha's names, but are currently labeled jcp every day. this means that martha stewart's lawyers will have to argue this claim as a part of their defense. they were hoping to clear the decks a little bit and make their defense a little bit simpler, but now they do have to include that. tomorrow macy's is going to propose a broader injunction than what's currently in place to also potentially include some of these martha celebration products that are currently for sale at jcpenney, things like plastic pitchers and plastic
