that is lower manhattan now down by the battery.now, lisa rubin outside the federal courthouse on pearl street. lisa, bring us up to date on the federal charges. >> reporter: so andrea, we do now have an unsealed copy of the criminal complaint that's been filed in federal court against luigi mangione. it has four counts in it. the first count is stalking and travel and interstate commerce. essentially it means that luigi mangione purposefully traveled from state to state for the purpose or with the intent to kill, injure, or harass or intimidate another person, and that in the course of engaging in that conduct, in fact, according to the indictment, traveled from georgia to new york for the purpose of stalking and killing brian thompson, the now deceased ceo of unitedhealthcare. the second count, andrea, is also a federal stalking count. that's stalking use of interstate facilities and that's saying that luigi mangione in the course of stalking brian thompson with the intent to kill him used a cell phone and interstate wires as well

the charges in manhattan have to be brought by the manhattan da's office and they're probably typing that paperwork as we speak in constant communication with those in pennsylvania as to what they can put into the charging documents in manhattan. >> and, john, you're back with us now. talk to us a little bit about the things that would need to come together to make this case. >> well, it has the potential to be an extraordinarily strong case based on the evidence. we know about. so people briefed on the investigation have told us that they have extracted dna from a phone from a water bottle that he drank from, from a power bar that he ate and these things were discarded along the trail where he fled after the shooting. now, if this individual who's in custody is the person behind this crime, the dna should match to the individual the print may match the individual because you can't eliminate that somebody else didn't handle the phone, but the gun that he's arrested with, with the suppressor, that's going to be key. once they fire a bullet through that gun and look at the shell casing

this manhattan district court. he's facing an 11-count indictment including a charge of murder in the first-degree. there's another count against him called inference of terrorism. the manhattan district attorney, alvin bragg had said this is the charge against him for the killing of ceo brian thompson. this was just on december 4th, and he said it was intended to invoke terror. some are saying, however, it could be problematic to bring that particular charge against him, that charge that was only brought up in terms of being a possible charge post-9/11, but we should point out that when he was taken into custody back in pennsylvania last week, nypd officials say that mangione was carrying a three-page handwritten letter that was critical of corporate america and he had a ghost gun they say, that was a ballistic match to the one that was used to kill brian thompson. the maximum penalty for both of these charges could be life in prison without parole. there is a talk of possibility of him being charged with a federa

>> i would say that's highly unlikely outside of manhattan.ave been covering trials in that city and anything is possible in manhattan. particularly if you have a motivated prosecutor like bragg. he is less motivated in more serious crimes, in my view. i can't imagine my prosecutor would bring this case. it's hard for me to see how any citizen after this case would put themselves at this risk to intervene and help others. part of the problem with being the defense on cases like this is that you see the prosecutors slow down the tape. they break it up into little bits. it leaves the impression that this strangulation went on for days. this is a rapid response to a dangerous situation, and the defense has to constantly remind the jury of that fact. i think penny did himself a great service in waving his right to remain silent, speaking in the interview. what comes across is someone who is trying to protect others. he did not know that he had died, but he talked about penny continued to resist. also the evidence in this case shows a lack of damag

one possible break in the case coming late today after police launched a drone search over manhattan central park, looking for the backpack worn by the shooter. a grayback was located, according to two senior law enforcement officials. investigators now looking to see if it is the bag worn by the suspected shooter. a senior official saying it will be searched for fingerprints and dna. police officials hopeful that releasing this image of the person of interest, the only visual revealing his face, will lead to tips from those who know him. the snapshots coming from a hostel on manhattan's upper west side, where according to a senior law enforcement official, the man only took his mask down in order to flirt with an employee at the hostel's front desk. the images essential to nypd's efforts to establish an identity through facial recognition, to help solve a calculated murder that is also rattled an entire industry. >> this is so unprecedented, it has really made a lot of executives very much on edge. >> reporter: the insurance sector, now making dramatic changes, some leading companie
