, what was kept at mar-a-lago, despite these efforts to get it back. the photos say the word declassified on the front of them. the word declassified is not appearing in this filing we're getting from trump's team tonight. maybe they'll use it in court when they're talking about trying to get the special master. we don't see it so far. going back to the efforts that they're describing here, in one part of this, they're describing the enforcement of the grand jury subpoena by the justice department as trump allowing investigators to come to his home and provide security advice. that was after that june 3rd meeting, where jay brad, who is the top justice department official, went to mar-a-lago, met with attorneys, went to the storage room where boxes of documents were being held. they, according to the justice department, were not allowed to look inside these boxes. they said they were explicitly prohibited from doing so. but they also followed up, asking trump's attorneys in a letter to further secure the room. they did not explicitly say, put a padlock

mar-a-lago, top secret classification. does that mean nothing was in them to begin with, they're being recycled? or does it mean maybe information of a top secret nature could actually be missing now and unaccounted for? >> yes, so that's certainly one of the unresolved questions here. and obviously i believe that's something the fbi would like to know is what was originally in there and when. it certainly could be the case that when they were packing up the white house to move everything to mar-a-lago, they just stuffed things into these folders that had nothing to do with classified information that they have previously been used in that manner, but weren't currently being done. but that's an unresolved issue that has to be clarified. the reason -- everybody is trying to figure out why donald trump would do this. donald trump is a notorious pack rack. he likes souvenirs. he thinks it's cool. he thinks this is stuff he can have and show off to friends at mar-a-lago. he has no understanding of what the security rules are o

these were in mar-a-lago for more than 18 months. what could happen if this kind of information fell into the wrong hands? >> well, first of all, it's the duplication that has always made me worried. one of the reasons why you view it in a scif or make it inaccessible to say cameras on iphones is you really do not want people emailing, it xeroxing it, circulating it. so, just the fact that it was sitting around means anyone, including trump, could come along and copy it and then share it with someone else. so, is the copying and duplication that is worrisome. and then of course it's the foreign spiraling and espionage to get their hands on it and now they know something about say another countries nuclear capabilities or limitations. and then the third is, you know, are there exchanges being made for this information? this is what we do not know. this is why. so i think it is. but i want to just really sort of second your point. we're so focused on the picture -- >> right, exactly. >> all this classified information. it's the obstruc

either things mar-a-lago didn't turn up in the search. these have become questions that the archives to be asking. it is possible that some documents, they may not know were created, and were also destroyed. so the archives only knows what they know but donald trump created something with no record of it, and destroyed it and that should be an archives. they may never give that talk me back even though belongs to the people and not him. >> the national archives folks aren't sure who would be sure? >> -- let's remind our audience, we asked donald trump to return everything, he didn't. we asked for subpoenas, he didn't. and they said give you everything, back and they didn't, as we learn from the fbi search from mar-a-lago, turned up 100 classified documents. so who is it that can assure us that all the records have been returned? >> right, it's a troubling question. whether donald trump's lawyer we've negotiated perhaps in a good state at some point. top 20 months to get it back. obviously, when the fbi search mar-a-lago, they've found man

i want to ask you about the mar-a-lago case. this kind of case. would you charge donald trump based on the evidence that is public facing. >> it is always frustrating me when i was u.s. attorney for southern district when outsiders would opine on something or add comments when they didn't have any evidence or a sliver of evidence so i'm not going to speculate about that. but what i will say is, what strikes me is the most significant revelation is that the department of justice is investigating donald trump and those around donald trump not just for the mishandling of classified information, but for obstruction of a subpoena requiring the production of that classified information. that is a very, very serious charge and if that were in the southern district of new york, that would have a highest priority and we would be moving on it very, very quickly. and you see that kind of urgency in the filings of merrick garland in this case. the department of justice wants to move forward very quickly. >> we should tell our viers this is
