let's bring in our state department correspondent margaret brennan. margaret, the u.s. has a clear policy of not negotiating with terrorists so what happened here? >> reporter: well, that's the policy, but in this case, the president directed u.s. diplomats to deal through a third party, in this case, the country of qatar, which has relations with the taliban. so when president obama and secretary kerry said today qatar's help was vital, that is what they meant. before going through with this swap, president obama spoke with the ruler of qatar and got his personal assurances this deal was legitimate. it was very risky, because a past try by qatar to broker a peace deal between the taliban and the afghan government feel apart because of some basic missteps, but this time qatar delivered. >> axelrod: now secretary kerry also reports, that afghan president karzai was only informed of the swap until after it happened. what does that tell us about the state of relations between the u.s. and afghanistan? >> reporter: well, remember karzai is about to be replaced by a newly el

margaret brennan is traveling with the secretary. she is inside the american embassy in baghdad. >> reporter: good morning. and good morning to our viewers on the west coast. here in baghdad, secretary kerry has been in back-to-back meetings with iraq's top political leaders. he's trying to broker a political solution to this crisis, but u.s. officials say there is no clear solution on the military front. in a two-hour long meeting with prime minister maliki kerry said you must form a new government quickly that has grassroots support. the administration has made clear that it wouldn't mind seeing a new prime minister but they have stopped short of asking maliki to step down. with all of these competing interests, there is extreme anxiousness among both sunnis and shias who have seen that the iraqi military is just unable to stop isis. in the meantime here at the u.s. embassy, military advisers are waiting to arrive. the u.s. is still trying to work out some of the legal protections. they won't have the same ones that are automatical

margaret brennan is at the state department where authorities say it took months to work out the details, the talks restarted around early december, around the same time that defense secretary chuck hagel met with the new qatari emir in doha. this was months after the taliban released a video showing bowe bergdahl to be alive but in frail health. that really prodded the administration to act. a previous qatari broker deal to swap bergdahl had broken down months before, just the previous summer, but this time the taliban was ready to trade and the administration's position was that this would be a step towards a potential peace deal. so the decision to move ahead really just came in the past few weeks after the qataris helped sort out security arrangements for the five taliban fighters to stay in that country for a year. now, u.s. policy doesn't allow for direct negotiation with terrorists, but president obama was able to bypass that by telling u.s. diplomats to deal with qatar as a third party. so its leaders have really tried to carve out a diplomatic role for that small, rich country t
