marianne favro what does it mean to be a sanctuary city for pot? >> reporter: well, this proposal would prohibit city employees and agencies from helping authorities enforce federal marijuana laws. pot may be legal in california, but the federal government still considers it illegal and now that attorney general jeff sessions removed guidelines that directed u.s. attorneys to leave marijuana businesses alone, federal action against cannabis is more likely. >> this resolution is responsive of jeff sessions efforts to recriminalalize. >> reporter: so berkeley city councilman coauthored a resolution that essentially tells the feds, if they want to go after pot clubs they're on their own. they won't get help from berkeley. >> tonight's resolution if it passes sets a tone, sets a policy to protect our industry here and protect patients and going forward, it enables some sense of security. >> reporter: berkeley's had a history of shielding its cannabis culture. the city directed its own police department to make marijuana enforcement its lowest priority.

mary a marianne favro has more. >> reporter: the concern from some is that now that this recall is on the ballot, some judges may make decisions based on the fear of being recalled. a milestone today for those fighting to recall judge aaron persky. supervisors placed the issue on the june 5th ballot after their group collected 95,000 signatures. recall supporters contend the superior court judge gave too lenient a sentence to former stanford swimmer brock turner, six months for sexually assaulting a woman outside a party. >> the voters will have an opportunity to weigh in on judge persky's pattern of bias. >> reporter: retired judge is against the recall and said persky followed the rule of the law. >> this judge did what i believe other judges have done, i certainly would have done, which is grant him probation and give him some time in jail. that's a lawful sentence and absolutely appropriate given the facts of this case. >> reporter: she also argues that the recall effort may hurt minorities in the court system. >> they're going to be impacted by this recall because if it succeeds,

nbc bay area's marianne favro broke the story last summer. she joins us live. marianne, this has been going on for a while now. so what's the plan? >> reporter: it certainly has, jessica. in spite of added patrols and beefed up security inside the trucks, two u.s. postal trucks parked on mildred avenue in willow glen were broken into in broad daylight on monday morning. 19 postal trucks have been broken into in san jose since last spring. it appears the thieves are becoming more brazen. on monday they stole mail out of two different locked postal trucks parked a block from each other in willow glen. postal inspectors say that's unusual. >> two break-ins in such a short time frame is very concerning to us. >> reporter: the thieves stole both letters and packages. a big concern for jenna vaccaro. >> i get checks all the time in the mail, i'm a freelancer. i rely on the mail toge
