nbc bay area's marianne favro joins us in fremont this evening where a memorial is growing for lance corporal andrew silva. >> reporter: hello, raj. the scene here is very touching. all day long friends, family and even strangers have been stopping by to pay their respects at andrew silva here at the intersection where he was killed. you can see there are photos of him. his combat boots and gear and even one of his favorite meals. today the man accused of hitting and killing him while allegedly driving drunk was in court. alexander yon is accused of murder, vehicular manslaughter and felony hit and run. his arraignment was postponed until next tuesday. today, silva's family told me that 23-year-old andrew silva was not just a great marine, he was a great dad to his 2-year-old son, noah. >> he was a really great dad, actually. he puts his son above everything else. whatever his son wanted, he gave it to him. that's the type of person andrew was. if my nephew wanted to play at 3:00 in the morning, he'd get up at 3:00 in the morning and start playing with my nephew. >> reporter: silva h

marianne favro is live with more. >> reporter: hi, janelle. i'm here at the creek trail. the creek is moving swiftly right now, which is why a section of the pike path is closed because of flooding. despite our storm, lexington reservoir is up only 0.7%, compared to monday. because of the positioning of the last big storm series, much of the south bay got the short end of the downpour. water experts say this storm is different. >> every little bit counts, because we have been waiting for this and we've been frustrated with recent storms that have gone north or south. but the impact locally is minimal. the reservoirs have increased about 1%. >> reporter: across the south bay, the recent rains have increased all our reservoirs by 1%, and while it's not much, experts say i help us recharge our ground water, which we rely on during the summer. the other positive thing happening right now is this week's storms were spaced out, so that allowed the ground to soak up the water and reduce the risk of flooding. of course, water district experts we talked to today say they are encou

marianne favro joins us from the hall of justice with the story. >> reporter: good evening., officer jeffrey graves had a protective order filed against him. today he stood silently next to his attorney and only said three words, yes your honor, he didn't enter a plea. dress in a black suit, jeffrey graves made his first court appearance since being arrested on suspicion of rape. he's accused of raping woman in september of last year after initially responding to a domestic disturbance between the woman and her husband. the woman's dna was later discovered on his bulletproof vest. >> if there is forensic evidence in the case, and the evidence is still on going and being accumulat accumulated. >> reporter: deputy district attorney says there is enough evidence to prove the case beyond a reasonable doubt. but some legal analysts say because the woman delayed reporting the crime, that may make convicting graves more difficult. >> the fact that it appears that this allegation didn't come out for several weeks, is going to create problems for the prosecution and they are going --

marianne favro joins us. >> reporter: he stood quietly next to his attorney in court today and did not enter a plea. he waived his right to a speedy trial. he's accused of raping a woman in a hotel after initially responding to a domestic disturbance call between the woman and her husband. her dna was later discovered on the officer's bulletproof vest. >> based on the evidence we have, we believe we can prove this case beyond a reasonable doubt. >> reporter: today a judge ordered graves to turn in any personal weapons. he was also ordered to stay more than 300 yards away from the victim and not contact her by phone or e-mail. in 2011 graves had a protective order issued against him after a custody battle with his ex-wife. prosecutors say there would have to be a relevant evidentiary reason for bringing that past case up during this current rape trial. he remains on paid administrative leave. he is also out on $100,000 bail. but if he is convicted of this rape charge, he could face eight years behind bars. reporting live in san jose, mar marianne favro, nbc bay area news. >>> police are

marianne favro joins us from the scene of the first robbery, marianne? >> reporter: good evening.irst attack happened here at the parking lot. this is located just across the street from campus housing, but we do want to let you know the police find this extremely alarming because they believe all three suspects were carrying handguns. today santa clara university students were buzzing about two armed attack the on and near campus. >> to hear something that happened like this is scary, you know, makes you pay attention more. >> reporter: around 1:00 saturday morning a santa clara university student was robbed at gunpoint while here in the parking lot of the stadium. the suspect stole his cell phone and wallet. police say a few minutes later, and just a few blocks away, another attack was reported here at park and mission street. three armed suspects tried to rob three students. >> one of the victims was knocked to the ground by the suspect, and the suspect did strike the vehicle on the face with a handgun. >> reporter: police say it appears the same suspects were involved in both

marianne favro looks at the guidelines and how the company is hoping to get the customers to stick to them. >> reporter: in january, the reservoir south of san jose was so shallow you could see a car stuck in the floor and after the rain, water covered the car but it won't stay this full for long, which is why last month the santa clara water district board asked users to cut use by 20%. it's up to san jose water companies to make sure it's 1 million customers conserve. >> we're regulated by the public utilities commission and we're filing an application to enact rules that would allow us to get to the 20% target. >> reporter: if approved, san jose water would ask customers to repair leaks within five days, stop washing downside walks and patios, only water on assigned days based on your address and stop watering during the day. the reason san jose water companies are asking not to water the lawn so much is half of all water used by a household goes to landscaping. san jose water

marianne favro, nbc news. >> a young woman was assaulted in downtown oakland but managed to escape. police are asking for your help in identifying this man accused of kidnapping and assault. it happened on tuesday afternoon about two blocks from the plaza. the suspect allegedly grabbed a 27-year-old woman from behind and dragged her backward. the victim, though, did fight back and was able to get away. >>> a violent home burglary interrupted by a san mateo woman. that suspect now in custody. san mateo police tracked down hugo mangua at his redwood city home on wednesday. according to officers he was robing a moment on march 17th when the homeowner walked in. he had a gun, the burglar did. he tied her up and took her atm card. this atm photo generated leads for the police. he's charged with robbery, assault with a deadly weapon, and kipping. >> he says he feels like the luckiest guy in the bay area. jose castilla was sleeping in his brand-new car when it was destroyed. an exploding propane tank blasted through the room. amazingly he suffered only a sore shoulder. the tank came from a

reporting live in san jose, marianne favro, nbc bay area news. >> thank you, mary ann. the family of a woman found dead in a stairwell at san francisco general is filing a claim against the city. lynn spaulding's family is accusing the hospital and the sheriff's department of medical malpractice and negligence. nbc bay area's cheryl hurd is live at the hospital with more findings. >> reporter: here's a cope of the claim. it's 22 pages long. in it there are a few new revelations. one is lynn spaulding's state of mind while she was here at the hospital. the other is why the stairwells were never searched. the claim gives the public a clear indication of lynn spaulding's state of mind before she went missing. the document states this a nurse told the doctor that spaulding was anxious, restless and disoriented. she also reported that spaulding thought she was working in an airport unaware of what she really was. the claim goes on to say that a doctor told the nursing staff spaulding needed to be watched. >> and there's a written order by the doctor that says all in capital

marianne favro has been on top of this story since it broke. legislators. >> reporter: legislators had a lot of questions, but after the hearing i spoke with several of them, and they said they didn't feel administrators had answered those questions. today at san jose state, the assembly select committee held it's first hearing on campus climate. at the heart of the hearing were questions about what happened in a dorm room. an african-american student says he was tormented and bullied by some of his roommates. the victim, donald williams, jr., claims his roommates bullied him, usualed racial slurs, and put a bike lock around his neck. the hearing comes two days after williams filed a $5 million claim against the university over the incident. today the university president admitted change was needed. >> the abuse

marianne favro broked sto the s and joins us now. >> reporter: what's surprising is the victim was walking in a group. santa clara police just released this surveillance video taken at santa clara university early the morning of march 1. if you look closely, it shows a group of students walking and at least one man in a hootdy pointing the gun at one of them. police say the suspect stole the victim's cell phone and wallet. this shows the suspect running away through the stadium parking lot. just a few blocks away, police say three men held up three male students at gun point, shoving one victim to the ground and pistol whipping him. >> actually, it was my friends that were involved in one of the robberies. they were coming back from a party, and they were with a large group, so i'm surprise thad they got mugged. >> reporter: now nearly three weeks later police have beefed up patrols near santa clara university and are still searching for the suspects. >> hopefully that someone will come forward or will prevent another robbery from happening. >> reporter: some say the attacks have convinced

that was marianne favro. >>> new details in the deadly stabbing of a south bay teenager. it happened in campbell. the man accused of killing the teen gave us a jailhouse interview. he says it was self-defense. damian trujillo joins us from morgan park in campbell. the suspect in this case was also hurt, correct? >> reporter: you can see visibly during that jailhouse interview, both friends of the victim and the suspects say it was self-defense. now it's up to police and the d.a. to determine what exactly happened here. >> and they wouldn't stop, man. probably would have got kicked in the head 60 or 70 times in 45 seconds. >> reporter: that's the claim from todd that were arrested in connection with the stabbing death of ivan diaz, a 16-year-old from san jose. he says he was forced to defend himself. >> i so grabbed -- i had my knife in my belt and grabbed it. i wasn't even swinging at anything. i was just swinging for him to get away from me, you know, and i swung, but i thought i hit air, man, but come to find out i actually hit a person, and i really don't feel too good

marianne favro has been on top of this story since it broke. she was there today when teachers and students met with legislators. >> reporter: legislators had a lot of questions, but after the hearing i spoke with several of them, and they said they didn't feel administrators had answered those questions. today at san jose state, the assembly select committee held it's first hearing on campus climate. at the heart of the hearing were questions about what happened in a dorm room. an african-american student says he was tormented and bullied by some of his roommates. the victim, donald williams, jr., claims his roommates bullied him, usualed racial slurs, and put a bike lock around his neck. the hearing comes two days after williams filed a $5 million claim against the university over the incident. today the university president admitted change was needed. >> the abuse inflicted on this african-american student by several of his residence hall suite mates was wholly unacceptable. our students deserve better. >> reporter: students say they have se

marianne favro joins us live by the theater with more details. good morning. >> reporter: good morning, laura. this theater was built in 1964 and hundreds remember watching star wars here. when this movie theater first opened you had reserve seating here. but now on march 31 it's going to show its last movie. the owners of the property want to strike a deal that would likely destroy the domes, the preservation action council of san jose is working to preserve all three domes but especially century 21, the oldest. the executive director talked to us last week. >> the architecture and the time period it represented and that it's intact, it has been changed very little from the time so it's representative of that period. >> reporter: council member pete constant is not convinced. >> i don't think there really is any purpose in preserving that theater. whether you look at it from a historical point of view, it's younger than i am. and i'm 50 years old. >> reporter: so far the preservation action council collected more than 5,000 signatures from peopl
