marianne favro is following this story, live at the hall of justice in san jose where she learned new information about the suspect's criminal history today. marianne. >> reporter: yes, janel. this isn't the first time alfonso eddington appeared before a judge. four months ago, he was arrested for battery. 23-year-old alfonso eddington walked into court today in handcuffs. he kept his head down as he was arraigned on kidnapping charges. he's accused of kidnapping a 3-year-old boy at the millipedepitas library friday. >> they were complete strangers. >> reporter: police arrested him less than an hour after he allegedly kidnapped the boy thanks to an alert bus driver who noticed the boy matched the description of a kidnapped child on an alert and called police. >> i saw his red shoes. that was a red flag for me to call this in. >> reporter: this was not eddington's first time in court. court documents obtained by nbc bay area show he was arrested in downtown los gatos february 25th for battery. he had ington pled no contest to slugging a man in the face and sentenced to two years probat

that's where we join nbc bay area's marianne favro with the latest on this investigation. what do we know? >> reporter: well, peggy, you can see behind me the entrance kiosk. what we do know is that the body was found about 40 yards away from the entrance in the bushes. a man hearding sheep discovered the body around 6:30 this morning. the victim is a male teenager or young adult who suffered one gunshot wound to the chest. east bay regional park police are investigating the death as a homicide and have not indicated whether it appears the victim was shot here at the park or his body was dumped there. the coroner is not releasing the identity of the victim at this time. investigators closed the park for a few hours this morning to search for evidence then reopened it at 11:15 this morning. park goers are stunned. >> it never happens when we come in here like early morning, 6:00 and take like hour and a half walk around the mountain and everything and we didn't see anybody. >> reporter: investigators say they looked here and they did not find any weapons here at the park. r

nbc bay area's marianne favro is at the hall of justice in san jose with some new information about his criminal history. >> reporter: raj, court documents reveal that he was arrested less than four months ago for battery. police arrested 23-year-old alphonso eddington friday after he allegedly snatched a 3-year-old boy from the milpitas library. today eddington was in court, arraigned on kidnapping charges. >> this case began as every parent's worst nightmare. when your child is kidnapped in public during broad daylight only a few feet from you. >> reporter: fortunately about an hour after he was kidnapped, the boy was rescued and returned safely to his parents, thanks in large part to an alert vta bus driver who noticed the boy on his bus matched the description of a kidnapping victim described on an alert. that's when tim watson alerted police. >> i wanted to look at the clothing article on the little boy without the gentleman going what he was doing. so i was just looking around looking under there and i saw his red shoes. that was a red flag for me to call this in. >> reporter: inv

that's where marianne favro joins us. how is the party? >> reporter: it is already starting terry. hundreds of cyclists have been pouring in after completing a ride from san francisco to santa cruz. this is leg one of the seven-day, 545-mile ride. 2,350 cyclists are riding this year to raise millions of dollars to increase awareness to hiv and for research for those living with aids. they raised a record-breaking $6.3 million. and a big chunk of that money will go to the san francisco aids foundation. we talked to one man who is doing this ride. 19 years in honor of a roommate who died of aids. >> it was 1987 i thought, i'm not really a cyclist, but i thought i'll do this ride. i never know what to do. there's something i can do now. >> reporter: the cyclists will be staying in a tent city here at the park which is being run by 600 volunteers. they'll get a little bit of shut eye and get up bright and early at 6:15 tomorrow morning and hit the road again, this time headed to king city. with we wish them well. nbc bay area news. >> now to a fight over facebook names. protesters, inc
