anderson of tarrant county texas and cnn legal analyst, mark geragos. sheriff, if i can begin with you, what information are you able to give us on where ethan couch and his mother are being held and when you expect them to be brought back here to the u.s. to face charges? >> they are still in the custody of the mexican authorities in mexico. we expect within the next 24-48 hours for them to be brought back to the united states. obviously we won't publicize or talk publicly about when that occurs for security reasons. but i expect them to have them back in tarrant county very soon, locked up in a facility. >> looking at this, it looks like something that they both skillfully planned. they even had a going-away party before they left which would have seemed to have given authorities an opportunity for people to warn they were going. is that what you believe now? they took meticulous plans to leave the country possible for good? >> i do believe that. i don't know for good. i certainly think they planned to run and run a long way and for a long time. i sai

let's be clear and mark geragos, i think will agree with me. prosecutors control the grand jury.cutors control the flow of information. which evidence is presented. if you want an indictment, you get an indictment as a prosecutor. this prosecutor didn't want an indictment. >> that's not true at all and you know it's not. did you always -- >> very true. >> in fairness, mark, i do want to ask you a question as a defense attorney. there have been a lot of cases like this and i don't want them to merge together because the circumstances are different and we don't want to make the mistake. for my sake and the sake of my viewers, what is the legal standard and what would a prosecutor or grand jury have to prove that a police officer used force unreasonably because that was a big judgment in this case, would a reasonable police officer have made in the judgment and decided yes, based on mistaking for instance the gun and being a real gun. what standard, is there a standard, an identifiable standard that prosecutors have to reach to get charges against a police officer? >> look, i joking

i have mark geragos joining me now and danny savalos. two top attorneys.en, we have a lot to talk about. danny, beginning with you. i'm curious, apparently inside this courtroom, mr. cosby did not enter a plea. can you tell me why? >> so this is just a preliminary arraignment. the very first appearance before the where bail is set. going forward, this defendant will next have a preliminary hearing. that is scheduled very, very soon. it has been scheduled and that's the hearing where the common wealth must show, not beyond a reasonable kout doubt, this is not the trial phase but instead a preponderance of tevidence tht number one a crime was committed and number two the person at this table committed the crime. if they do so and most cases are held over for trial this case will be held over for trial. it will leave the district court, mdj as we call it, which is usually a very small building in the community and migrate up to common pleas court and there it will begin the trial process. and we discussed earlier there is a speedy trial rule in pennsylvania,
