mark gurman joins us now from l.a. what is your take on this story? mark: two things.e makes a valid point. these applications are using a technology which is pretty improves -- intrusive for computer applications so it makes sense to pull them off of the app store. this is something that has been going on for over a year where apple has been slowly purging any type of application that uses that technology. the question is which applications that have that technology for the past several years, what kind of impact have they had on consumers? that is what we need to find out. emily: apple released a rare statement saying we did it for a simple reason -- they put user privacy at risk. parents should not have to trade of their fears of children device usage for privacy and security. it makes sense but it is also convenient given that apple has made privacy a big issue, has focused on screen time. do you see that? mark: it is convenient and the timing is very interesting, but i happen to actually believe apple on this one. i'm not sure what the benefit to apple would be re

mark gurman is in san diego. was not quite that surprising to see these two sides coming to an agreement that benefits both of them. what have they ended up gaining? mark: yeah, it was not a surprise they were eventually going to go down this road. apple was denying it was nearing a settlement, whereas the qualcomm ceo had been talking up a settlement for months on tv. they both benefit. apple has a very clear and clean path to releasing new iphones and ipads next year with those faster five g networks -- five g networks. qualcomm sees the business model being certified and vilified with apple being in agreement with them by settling, so to speak. haidi: is this the end of qualcomm's troubles. we saw the huge surge in the stock price. clearly come investors feeling optimistic. still waiting for judges decisions on the federal trade commission accusations as well on anti-competitive behavior. mark: marright. we're still waiting on the ftc situation and class-action situation but this apple trial was the big one. t

mark gurman, thank you. the elon musk s.e.c. saga continues. in early april, a u.s.uys two weeks to resolve their differences. if they cannot negotiate, renegotiate, she said she would determine whether or not to hold musk in contempt or not. now they are asking for more time. in a joint letter, the deadline for their resolution on thursday, the tesla ceo and the s.e.c. said they had been unable to reach an agreement over musk's social media activity. joining us to discuss is dana hull. they have failed to reach an agreement, what is the latest? dana: they met and talked for an hour by phone, musk's attorney, the s.e.c. general counsel, they asked for more time, and the judge said yes. i think it is telling that they haven't received an agreement. they need to nail down, how does he use social media, how is it vetted, how is material information embedded ahead of time. emily: what is it that they need to back ahead of time? dana: the issue is that the judge was a clarified agreement that would make clear how his tweets are being reviewed, are they being reviewed ahea

mark gurman weighed in on the news. >> this is the phone, and it will be the last time you will see men air until they relaunch it. they are picking it up tomorrow morning. i received the phone last monday, it has a plastic film on it that looks like what you would get on any phone, even samsung phones, iphones, that you remove before using. typical user experience. but about 48 hours after removing that plastic sheet, the phone was completely dead. the left side of the screen went out completely after about a day. the next day, it was 75% dead across the whole thing. and by wednesday morning, it was completely gone. in my book, the difference between a $2000 phone working and not working should not be a thin piece of plastic. emily: what is your take on this? >> i think i agree with mark. that is a big starting point. overall, this is a big sign that the industry was not ready for this. this is a big issue for samsung in general because their name is attached to this, but it is a bigger issue for the category in general. overall. they are trying to launch something new, there was not
