kpix 5's mark kelly explains why. >>> reporter: it's due to a car accident sheriff ross mirkarimi got into just a fender-bender but the dmv says the sheriff never reported it like the law says he should. we wanted sheriff ross mirkarimi to tell us why he was illegally driving on a suspended license. we tried his house. does the sheriff have time for an interview? >> he is not here. he is in the office. >> reporter: at his office? [ knock knock ] >> reporter: were greeted by a locked door. his press person did write to us saying the sheriff had no idea he needed to file paperwork. the sheriff only learned of this from the press inquiry when the accident occurred he contacted his insurance company and was informed that everything was in order. but according to the dmv, everything wasn't in order. and after a warning that they had never received his accident paperwork, the "chronicle" says the dmv suspended the sheriff's license this past winter meaning he has only been allowed to drive to and from home and office. on what this could mean for the sheriff's chances at getting re- elected?

. >> mark kelly picks up the story where the police chase ended. mark. >> reporter: ken, for three hours, the s.w.a.t. team had this neighborhood in oakland on lockdown while they were looking for their suspect. and shortly after 3:00 today, they found him. here you can see one of the two suspects strapped to a guerney hands tied behind his back paramedics putting him into the ambulance. now, police arrested the other suspect several hours earlier and we spoke with one woman who saw the arrest go down while she was picking up her child from daycare. >> at the time, i -- i -- i wasn't sure what they were picking him up for, um, so obviously a little more terrifying after -- after learning, um, what the incident was. >> reporter: certainly is terrifying. police say these two men robbed and shot a san francisco tourist before fleeing here to oakland. now, there was a report that the suspect while he was on the run attempted to kidnap a 6- year-old boy in the neighborhood. but police tonight not confirming that simply saying at this time, there does not

as kpix 5's mark kelly reports now, that problem may soon be solved. >> reporter: forget the groceryre. at this san leandro home, fresh eggs get plucked straight from the backyard. that's for san leandro. but for backyard chick tones fly here in hayward, there's some concern. >> i'm concerned about it. >> reporter: also a concern the noise. chickens have a tendency to get talkative from time to time. >> they do make a mess. they do make noises. and they ought to be responsible for that. >> reporter: negatives aside, marian sanchez is all for allowing more backyard chickens in hayward like they do in san leandro, pleasant hill and a few other bay area cities. he just thinks the permits should be cheaper. now it's a whopping $500. is that too expensive? >> maybe half that. 250. >> that's a lot $500. >> reporter: the city agrees. and if the rules change, hayward could be chicken- friendly by the fall. >> trying to look at ways to simplify that process and fresh eggs are really great tasting. i think people like to have fresh eggs and have that disposal.
