you heard what mark o'mara had to say. he name checked you several times. what is your reaction to george zimmerman's attorney's comments? >> well, first of all, i say attorney o'mara is not being intellectually honest if he doesn't denote the racial undertones in this case. this is a civil rights/equal justice case, piers. it is the whole world watching to see if everybody in america can get equal justice. over two million people signed a petition that said george zimmerman should be arrested for killing an unarmed teenager. there were protests and rallies all over the country, in fact, all over the world that said you cannot send this irresponsible message that you can shoot an unarmed teenager and not even be arrested, go home and sleep in your bed that night. so there's a big element of civil rights in this matter. the police didn't even do a drug and alcohol analysis on self-confessed killer of an unarmed kid. they didn't even do a background check. they took his word as the gospel. they didn't knock on doors to see if this was somebody's kid. they just

it seemed to me that when mark o'mara was arguing these motions, it was a foregone conclusion.mation wasn't coming in but i'll say this to paul's point. it was masterful that the defense got this out there because now the jury pool, the perspective jurors do know a different side of trayvon martin. they have seen i'm sure many of these text messages, the photographs of trayvon martin holding a gun and i that could be helpful to the defense. >> mark, this is pretty big today, the fact the jury will not see the crime scene. how does that play? >> that didn't surprise me. really, very few of these rulings surprised me. as was stated, most of this is known to be inadmissible. it's going to be very close to impossible to replicate the weather conditions, the time it occurred and all the relevant factors that make it relevant for a jury to view this. so that didn't surprise me at all. you can replicate it pretty much with a video and matters such as that. i will say, though, this ruling allowed to have happen is that it streamlined the case. the case basically is supposed to now be o

and if mark o'mara wants to play the character game, fine. he's put all that information out there about trayvon martin. there are also things about george zimmerman that is already out there that people need to be reminded of. his july 2005 arrest for assaulting a police officer. the august 2005 order of protection that his fiance put out against him. and as joe ann reported, sometime back, witness number 9 who was the cousin who alleges that george zimmerman molested her when they were kids. while that is irrelevant, a phone call that she made to the sanford police department two days after the shooting the killing of trayvon martin is relevant in the case because she told police investigators at the time, to ask people, to canvas other people to find out whether george zimmerman was racist because she knew from being a member of the family that they didn't like black people, said disparaging things about black people. those are the kinds of things that are relevant that george zimmerman has to answer to. not trayvon martin being to a lot o

>> reporter: you can see defense attorney mark o'mara putting a brave face. the bottom line is pretty much he got shut out today. he wanted to delay the trial by six weeks because he said he was not getting the discovery fast enough from the prosecution. the judge, deborah nelson, denied that saying the trial will go forward as scheduled beginning on june 10th. the judge also ruled that the defense cannot bring up trayvon martin's past marijuana use, his high school suspensions, his alleged participation in school fights, some of them reportedly on video tape, and the defense cannot mention in their opening statements that trayvon martin had marijuana in his system. the judge also denied o'mara's request to bring the jury to the scene of the shooting. here now are the attorneys on both sides. listen. >> i'm very happy with the judge's rulingsment we were hoping that we would have some limitations on people commenting upon information that is not yet relevant, so the idea that the state has to be careful in how they present their case and certainly we're going

so, trayvon's -- i mean, zimmerman's lawyer, mark o'mara has filed three requests with the court.ts the judge to allow jurors to visit the crime scene. two, he wants the jury to be anonymous and sequestered. and, three, he wants zimmerman's wife shelly to answer questions in a pre-trial deposition. let's start with the field trip as i have been calling it trying to get the jury to go out and visit the crime scene. faith, let me ask you. is that a good idea? >> kelly, either side can request a jury view and that means to take the jury out of the courtroom and go to the actual scene of the crime as you just mentioned. here in this case the judge is going to look for special circumstances. and i think o'mara is going to argue, listen, the movements of trayvon martin and george zimmerman, that night are absolutely critical to this case. and we can't present it well enough through a map or diagram. we need the jurors to actually go out to the scene and walk them through the steps. i don't think it's a bad idea in a case like this where time, space, and distance are absolutely critical.
