mark o'mara. >> which he did. let's back up a little bit. an immunity agreement is a tool used by prosecutors. i as a prosecutor can say, i won't use this information against you. but the idea that they promise forevermore never to prosecute cosby would be way outside the norm of an immunity agreement and be permanent. what they can't do is use that precise statement against them in their case in chief. meaning, if there's other information out there -- i'll give you an example. we have similar fact evidence. he has a number of other victims out there he could bring in and say the sfakts of that case are so similar to the facts of this case that this jury should hear about it. that similar fact evidence was not available ten years ago and is very significant evidence. that's the first thing. second thing, if cosby were to get on the stand and say something in derogation or opposition to what he said in the deposition, it can still be used. if i go in and say the light was red in my deposition. i go to trial and i say the light was green. eve

drew pinsky and criminal defense attorney mark o'mara. dr. pinsky, what do you make of this?y racks up $1,000 at a strip club and can't pay for it. >> i make nothing of this. this kid's a drug addict who failed treatment and ran from the law and now he is engaging in the behaviors of his disease. you know, wherever he goes, he will continue to be him and he will continue to engage in and dick t addictive behaviors and his mother is going to continue to enable it. >> i don't understand why he's still in mexico. why hasn't he been sent back to the u.s. to face whatever punishment he's going to face? the u.s. has an extradition treaty with mexico. >> we do. but once his defense team decided to throw up the road block, that they were going to say we want a formal extradition hearing, then that process slows down a great deal. now, it may be a tactical decision. i'm not certain it's the right move but they may have decided, we'll let him sit in mexico until he gets close to his 19th birthday so by the time he comes back the juvenile court has no control over him. there may be thin

all of this, attorney and nra instructor and gun dealer, and we're joined by criminal attorney mark o'mara far does this go? do you see this impacting gun owners and their ability to buy guns? >> not particularly. i think it's just as easy to buy a gun with a background check. i think you'll see the level of enforcement. it's like the immigration executive orders where the president took away resources from enforcement. here he's adding resources to enforcement. >> critics of the president say he's out of bounds with this gun proposal, but it doesn't sound that that's the case. >> well, firstly, i think he has the right to do most of what he does. there have been arguments about his overstepping his authority with certain executive orders, but the executive branch executes the laws passed by congress. what piece doing, i think, is trying to polish what he has tried to get through the congress and can't. he's trying to polish it with these executive orders. now, what effect is it going to have? this is not a perfect solution but i think it's a step in the right direction. there's no questio
