perspective from mark romero and shan wu, who is also a former federal prosecutor.the defense clearly tried to undercut the credibility of police who responded to the murder scene, asking them if they put on protective boots. they said they didn't. if you were defending alex murdaugh, would you do this? >> yes. it's a valid strategy. don't forget, we defense attorneys do not need to prove innocence. we need to prove reasonable doubt. and the way we do that, we do whatever we can to show the investigation was flawed, searches weren't warranted, booties weren't worn, all of this to tell the jury that they rushed to judgment that day calling nobody else but murdaugh and they were sloppy because lack in evidence is what leads to reasonable doubt. this is fairly standard. we're going to see this throughout the trial. >> one of the issues will be alex murdaugh's credibility, shan. you say the new evidence we heard from the body camera footage could be critical in undermining that credibility. why? >> well, there is a question there as to what his demeanor is at the time.

for more on what to expect, we're joined by mark romero. >> well, tomorrow is not going to be as significante a week from now. tomorrow is sort of a status conference. the judge will let them know what's coming up next. the most significant hearing, anderson, is going to be within about a week. 14 days from last week, they called a preliminary conference. that's where the state presents more evidence to try to show they have affirmative probable cause to keep him. and at that point, trial dates can start getting set. tomorrow, as said by the reporter, scheduling, keeping things on track always has to be a next court date. but i think the most significant one is coming up in the next couple of weeks. >> before the release of the probable cause affidavit, the suspect's attorney in pennsylvania says the suspect believes he will be exonerated. investigators seem to have what appears to be strong evidence against him, especially with the dna found on the knife sheath. what are the chances this would go to trial as opposed to plea deal? >> it's so hard to say. many of these cases, like the ones we

mark romero, who successfully defended george zimmerman.ly. back with us is john miller. are there holes in the case the defense could use in their advantage to your opinion, the fact that we don't yet know what the motive was. there's a number of arguments, i assume, the defense will be making about, perhaps, what may have happened. >> well, certainly. you know, we only have 10, 15, 20 pages of what's going to be 5,000 pages of discovery. but even what we know today not only is a lack of motive, but there's lack of this premeditation or any suggestion whatsoever that it is the most serious charge. so we default back to second degree murder, which is heat or passion. quite honestly they don't have evidence yet of that if you think about it. this could be a domestic violence fight that had a horrific consequence, the death of her, and then the cover up is what makes it look so bad. no matter what he did in the cover up, it simply does not change the level of crime, the initial crime, the murder. this may turn out to be the only thing the sta
