live now to mark zaid, a national security lawyer. mark, thank you forjoining us.ere to be convicted on the charges we've mentioned, would he go to jail? well, he certainly is facing jail time, well, he certainly is facing jailtime, possibly well, he certainly is facing jail time, possibly over 300 or so years, but that's not realistic obviously. espionage act cases, generally, if convicted for these type of offences, get anywhere around 3- offences, get anywhere around 3— six years. there are some false statement charges, obstruction charges. realistically, pushing aside donald trump is a former president, if convicted, that individual, if it were normal, would be facing jail of around 10-20 would be facing jail of around 10—20 years but is the former president of the united states and of course, if he drags it out and he is re—elected president, even if convicted from a federal standpoint, it can make the case go away, he would be in charge of the justice department or he can try and pardon himself which has never been constitutionally done so nobody knows actual

. >> with us now is national security attorney mark zaid. at actually doesn't do you service. this is your space. you know as much about these types of cases broadly speaking pretty much as any attorney in america. so how quickly can these attorneys get the clearances they need in this case, and what does this first order from judge cannon tell you about her? >> i think the order made a lot of sense. good for her, for taking charge and moving forward. i would already have imagined or expected that trump's at least minuscule legal team at the moment was in contact with the justice department to start coordinating this. but it was a good first appearance by the judge to take this step. the counsel are going to have to complete what we call an sf-86, standard form 86. that's the national security questionnaire for all of us to obtain security clearances. and it is very lengthy form, 130 or so pages depending on which version you are looking at. it will depend on what's in these lawyers' background. it doesn't have to be negative like an arrest.

joining me now isjoe moreno and sarah krissoff, former us federal prosecutors, and mark zaid, an intellligencepresents government and military officers among his clients. welcome to all of you, thank you for being with us. sarah, starting with you and coming to you, joe, after — you've been combing no doubt through the a9—page unsealed indictment. what stood out to you? i think the government really tried to put its best foot forward here, and they have not had the opportunity to date to set forth in a compelling fashion the evidence they have in the case. they did that here, they had a choice of whether to do a more bare—bones indictment or doing indictment that really walks the defendant, the former president and the public through the evidence here, and they chose to really prepare this robust indictment and so they can tell the world what the evidence is that they intend to go forward on. joe, what stood out to you? would you agree with that assessment there from sarah? yeah i would agree. i can see almost the opening statement at this trial, which is quite some time away still, if it happ

here's what national security law expert and mark zaid said about that. strategy of the trump team is going to be to delay, delay, delay. get this passed the 2024 election. there will be a lot of pretrial motions. particularly in the classified sphere. this is where judge cannon in taking little steps, can have a significant and lengthy impact. depending on how long that process takes, and as prime, entrance some of these cases are some of the decisions can be immediately appealed, up to the 11th circuit as well. >> you can hear a sense of what is realistic. is it the speediest possible trial versus a non speediest possible trial? how do you see it? >> this is not going to be a very speedy trial. i took -- quite a bit i think they're right on the money there and i think this was a more typical case in federal court. the bank, robbery a drug deal, something long does. lines even in that circumstance getting a trial done within a year is not a guarantee. and in this case obviously next year, there is an election season coming up with primaries and a convent

. >> joining us now is mark zaid. -- and security clearances at msnbc legal analyst, neil kotto. tment with you. we obviously, you believe what most people believe, which is it's a very serious charge. with very serious consequences if indeed vic inducted. -- it is going to be an interesting rollercoaster, that is for sure. what we're going to see in the near future is trump pulled together a legal team, and they're gonna have to decide who among them is going to ask for security clearance in order to see the classified documents, and litigate the pre trial motions under what is called the classified information procedures act. i think any of these attorneys at the moment have clearances, that process could just be a matter of weeks, if they get interim clearances, if there's nothing really in their background, which could be something non-in the way of malicious it could be their married to a foreign, or foreign relatives overseas, or could be arrest, whatever it might be. but the whole process could take months in and of itself, unless the federal government expedite sit. we're
