david: his denials stretch credulity to the breaking point, senator markey's denials.e was unaware his actions would have any effect on the stock itself which, he has to be living in a cocoon if he really believes that. let me ask a more dangerous question though. is it possible, could a politician actually trade, make a bear bet, make a short trade on a company that he has badmouthed in congress? >> sure, absolutely. you know, the fact is, and we've talked about this before, i mean they can trade stock. they can buy stock. they can short stocks, when it is related to legislation, that they're working on. they may hear something from, somebody who is contributor, who is, you know, shorting that is a hedge fund investor that is shorting a stock. they can go out and certainly criticize a company. that they, have shorted on the market. absolutely. there is technically nothing illegal with them doing that. it is, you know, it is very troubling. for all the talk we had that came up with the stock act where they were dealing with insider trading by members of congress, that

gerri: senator ed markey saying a massive information breakdown at nhtsa led to deadly vehicle breakdowns on our roads. as we know there are recalls of 1.6 million cars for gm. that also due to a problem with the ignition. you look at this record, and nhtsa was getting information all the time about what was wrong at gm, what was wrong at nissan, yet we don't get the problems fixed. why not? >> well in the nissan case, nhtsa actually did have some influence on that recall. nhtsa staff were in touch with nissan. in the case of gm the manufacturer should have but failed to make a defect determination back around 2004 many years ago and the agency didn't have all the information that it could have had. i think had the agency more information the agency would have proceeded to investigate and threaten to order a recall if gm didn't do something. but gm was not terribly forth coming with the agency and the agency perhaps didn't connect all the dots on the information that it did have. gerri: you know, thousands, i mean lots and lots of reports obviously but over a very long period of time. so

remember that i say to my friend, senator markey, the endangerment finding? anyway, i left the next morning for copenhagen and that afternoon they had the endangerment finding. before i left, i said, when you have the endangerment finding, it has to be based on some type of science. and she said it would be based on the ipcc. but, ironically, the timing couldn't be better. it wasn't a matter of weeks after that. it was a matter of hours after that that climategate was exposed. climategate was the -- it all started with east anglia university's c.r.u., climate research unit, that helps put together the science for the ipcc. it was disclosed that the ipcc was cooking the facts to either cover up data that didn't tell the story they wanted everyone to hear and exaggerated the impacts of the changing climate to drive people out of fear into action. now, there are three things that you need to know about the ipcc. first of all, the obama administration has referred to the ipcc as the gold standard of climate change science and global warming. some say its reports

there are republican members who when they were in the house voted for waxman-markey. there are a number of republican senators who have publicly said they think a carbon tax or a carbon fee is a sensible idea or is an idea they would support under the right circumstances. so there is a great opportunity to reach to colleagues on the other side of the aisle. once you get passed people who are elect the politically, you see republicans in abundance supporting doing something about climate. you discussed earlier -- the presiding officer, the distinguished senator from new jersey, discussed earlier the republican former e.p.a. administrators who came afford d to say, hey, guys, you have got to be responsible about it. george schultz has campaigned for a carbon fee to put a proper price on carbon. former representative bob inglis is out barnstorming around the country arguing that there should be a republican conservative carbon fee proposal. so even though that side of the senate has been empty all night since senator inhofe left -- and he was here to deny that there was

lobbying in washington and around the country to try to push regulators to investigate herbalife and ed markey, a congressman, he convinced him he should try and spark this type of investigations and looks like he has been successful on that front. he has been successful at least today in terms of what the stock did. it felt 7.5% and plunged after this news was announced and finished the day down about 7.5%. he has to see the stock fall quite a bit more until he makes a profit on his short bet on the company. >> someone also has made a long bet on the company is carl icahn. he has made money betting on herbalife. what happens now to bill ackman if the ftc hands him a little victory? >> this is a one-day victory. at the end of such an investigation the ftc only makes an announcement if it finds that the company was in the wrong. it does not make an announcement and say, we cleared them of any wrongdoing. they might say they close the investigation at that point and herbalife might come out and say we have been cleared here in the investigation and it is finished. herbalife said we welcome this

and i've joined a bill with the leadership of senator markey that would require better, faster disclosure by nhtsa, and i will speak on another occasion about the lapses in responsibility on the part of federal watchdog who failed to protect the public, who failed to detect a pattern of problems in these cars and who failed to blow the whistle. but g.m. has its own responsibility, and i know that a new era of leadership at g.m. under a new leader may mean a new day in its acknowledging its moral and legal responsibility. and i hope for that new day. the innocent victims of defective cars suffered life-ending and life-changing injuries. many of them could have been avoided but for the purposefully misleading and deceptive conduct by g.m.. our responsibility now is to see that justice is done either through ensuring that compensation is made available or through appropriate criminal enforcement. or both. because the criminal law, as we know in this body, is a means of seeking justice, and it can provide a good outcome if it is properly framed and enforced. so i thank you, mr. president. i y
