marla tellez is live outside the court house with the latest developments.ing. >> reporter: good morning, laura. yes, it was back in june that david lewis of east palo alto was shot to death as he was getting out of his car at the hillsdale shopping center in san mateo. now, for more than six months police didn't have any leads on a suspect. that was until december 18th, when they received a phone call from 58-year-old gregory elarms, an acquaintance. yesterday he was here in a courtroom where he pleaded not guilty to a murder haurj that carries a special circumstance allegation that he lay in wait, which essentially means that he was waiting for lewis to arrive at the mall that day in june. the charge carries the possibility of the death penalty if convicted. now, 54-year-old david lewis was a drug abuse counselor, described by his peers as a model citizen who had once served time and only wanted to help others in his situation. in the meantime, elarms is being held without bail and police still don't have a motive for lewis's murder. reporting live in redw

marla tellez has more on the story. >> reporter: good morning, laura.t's nice to tell you that this story has a happy ending. it is hard to believe when taking a look at the waters behind me. we are live in pacifica this morning. it is a choppy tide with the waves crashing. the coast guard said they received a 911 call after 1:00 this morning of an overturned boat carrying three people at kelly state beach in half moon bay. the coast guard dispatched a chopper and 47-foot rescue boat, but neither were needed. they were able to walk to shore when the tide got low enough. according to the battalion chief, the fire department boat slipped in shallow waters. they are lucky the ocean did not dominate the situation. >> the waters are dangerous and luckily the surf wasn't that bad. you are taking your in your hands when you go out there. >> whoever was at the helm may have just fallen asleep. all three are reported to be okay this morning. the big concern is potential pollution. officials say that boat is carrying 2,000 gallons of diesel fuel. at sunrise this

marla tellez is live at the site with what happened and what this all means. good morning. >> good morning. behind me is the explosion site. hard it get a good look at it. the barricades that are upkeep people away from the area. at issue is the recent finding that pg&e had inaccurate records about the pipeline that exploded back on september 9th. the roars are used to set pressure limits in the company's natural gas pipelines. critics say incorrect documentation can lead to running pipelines above safe pressures. about 10 days ago, the national transportation safety board which is investigating the ultimate cause of the blast ordered pg&e to verify records they gave the company a february 1st deadline while officials said we need more time. at a meeting last night, they extended that deadline to march 15th, giving pg&e six more weeks. assemblyman jerry hill whose district includes the explosion site where he expressed his outrage. essentially pointing the finger and blaming the president saying they are blaming the people and residents of san bruno. eight peo

live in oakland this morning, marla tellez, today in the bay. >>> breaking news. iran arrested an american woman on suspicion of spying. a newspaper reports she entered the country illegally by land and the paper breaking the news is not known for carrying accurate reports. the paper said the woman was detained in northwestern iran and an espionage device was found in her teeth. the woman is identified as a 55-year-old. i am not coming up with much on her. this is happening in the last minute or two. oakland police are investigating the city's third murder of the year. officers say around 9:30 last night someone was walking near 16th and center streets when they saw a man slumped over the car. they called police and the man was dead when they arrived. he had at least one gunshot wound and they have not arrested any suspects. with three murders in five days, oakland is taking a step back for the past two years. the number of homicides in the city has dropped. there were 90 in 2010 compared to 104 in 2009 and 123 in 2008. >>> alameda firefighters are mourning a loss

live in san jose this morning, marla tellez, "today in the bay." >>> it is 6:33 right now. boy is recovering from dog bites and bruises after his father fought off three pitbulls in a neighbor's backyard in union city. the boy's father tells nbc bay area three pitbulls attacked his son after the boy hopped a fence to chase a ball. he says right before the attack his son left his sight for less than a minute while they both played many the backyard. >> i had seen three dogs on top of him. one had his head in his mouth. the other one had his leg, they were trying to shake him like a rag doll. i tried to fight them off. i tried punching them, that didn't work. i grabbed a 2 by 4 that was laying around in the backyard. and i started hitting them with that. >> he threw him up to me, the first time i caught him he had blood all over his face. >> frightening. one of the dogs bit miguel under the eye where doctors glued it shut. the dog's owner was not home at the time of the attack. he didn't want to go on camera but is sorry for what happened. the boy's family wants the dogs to b

reporting live in san jose, marla tellez. >> thank you, marla. let's hope they find that little boy do. what you can to help if you see anything suspicious. >> south bay city considered one of the safest is fighting to keep its reputation after having six homicides in two weeks. leaders say that violent stretches of crime is an unfortunate coincidence and not a trend. officers are going to step up patrols and try to crack down on gangs. mayor chuck reed says it's crucial to try to avoid cuts especially to the police department. budget concerns may force the city to lay off a fifth of the police force right now there are about 1200 officers on the police force. >> a community meeting in palo alto in hopes of bringing about a dozen robbers to justice. there have been 20 robberies during the past four months in the usually quiet neighborhood, so far palo alto police made arrests of eight suspects. the department will host a meeting at 7:00 at the theater on littlefield road, offering up to a $10,000 reward for information leading to an arrest. >> uc

marla tellez is here with what caltrain is up against. marla? >> reporter: brent, what it comes down to is a $30 million deficit for the next fiscal year. that's about 30% of caltrain's $100 million annual budget. as a result, caltrain is planning massive cutbacks to services. roughly 42,000 people rely on caltrain every day during the workweek. it currently operating about 90 weekday trains between san jose and san francisco. under the current budget scenario cuts count mean more than 40 routes and would be dropped leaving commuters to choose from just 48 weekday trains. again, down from 90. weekday service outside peak commute times, weekend service and service south of this station would be eliminated altogether. part of the problem is caltrain relies heavily on passenger fairs which accounts for 44% of its operating budget. >> caltrain is the only bay area transit agency that doesn't have a dedicated source of funding. so every year we have to scramble to come up with funds. and our partners are going to reduce their contributions to caltrai

marla tellez has more on how it will affect you and health care. >> eight million californians rely on the health program that the governor wants to cut by almost $2 billion. they are referring to medi-cal. patients would have new copays. $5 per doctor's visit and $50 for emergency room services. $100 per day for a hospital stay. service could be denied to patients unable to make the copay as long as they are referred to a county program. medi-cal patients would have limits on prescriptions and doctor visits. the limit could be capped at six per month except for life-saving drugs and a trip to the doctor would be limited to 10 per year. under the proposal, doctors and nursing homes would be hit with a 10% cut in medi-cal reimbursement. adult day health care would be eliminated all together, making it more difficult for thousands of seniors to stay in their homes. >> yesterday governor brown said "it's better to take our medicine now and get the state on a balanced footing." how he takes aim at education and explain what it means for and you your children. >> san jose police are looking

reporting live in pacifica this morning, marla tellez, today in the bay. >>> thank you very much, marlaitching gears now, muni plans to handout more parking tickets in san francisco. the city told the chronicle the move is an effort to close a $21 million budget gap for the current fiscal year that ends june 30th. the agent fell a million dollars short of the revenue last year. projected expenses are up more than $9.5 million. >>> the federal government will tackle helmet makers for misleading safety claims and scentive practices. they want the federal trade commission to investigate leading helmet maker after claims that one of the helmets can reduce the risk by about 31%. he said there is no evidence to back up that claim. efforts to reduce concussions on professional and amateur athletes is in the headline after a study proved that the impact of concussions can be long-lasting. >>> 5:34 and antioch. we have slowing there again. highway 4 was the first to show slowing yesterday and we had speeds down below 20 miles per hour. at the commute back from any portions of the bay area after

marla tellez is live outside of the marriott at fourth and mission street with a look at what's happening. >> reporter: it started about 11:30 last night when firefighters responded to a call coming from this marriott here on fourth street. several people reported feeling flu-like symptoms. firefighters were dealing with a total of six people. two were taken to the hospital for carbon monoxide poisoning. all six were staying on the fourth or fifth floors. that's where firefighters pinpointed their search and detected elevated levels of carbon monoxide i'd. they zeroed in and it checked out okay. the bizarre element here is they did not find a source here. published reports say these people are flight attendants with singapore airlines and they all worked in the same plane recently. about 2:30 this morning, firefighters gave the hotel the all clear and cleared the scene. at no point was the hotel evacuated. the investigation has been turned over to the hotel engineers who are monitoring the situation. they have their own system to detect carbon monoxide. as for the two people taken to the

marla tellez is live this morning. some family members say the investigation is bringing them to a canal this morning. >> reporter: that's right. the suspect's mother is said to live here in san jose, but because he has family all throughout california the amber alert is still a statewide search this morning. but this morning investigators will once again focus on the delta mandota canal. after getting a tip from someone who said they saw a car go into the canal, the officials searched it yesterday. they did find a car, but late last night the sheriff confirms it is not the suspect's car. the search for 4-year-old giuliani cardinas starting tuesday afternoon when his mother's ex-boyfriend, 27-year-old jose esteban rodriguez, grabbed him from his grandmother's arms and took off in a silver toyota corolla. this happened in paterson 85 miles east of san jose. rodriguez is considered to be armed and dangerous. he has a criminal history, including a 1999 manslaughter conviction. still, giuliani's mother is keeping a positiv

our own marla tellez is out there with great news for drivers. >> reporter: good morning to you, mike. yes, that's right, this is one of the places you are going to find some fairly heavy fog this morning. we are just above 101 right off the marsh road exit. we made our way up from the station in san jose this morning. this is 101. some areas are hit, but once you hit palo alto you will enter the fog zone. behind me the morning commute is picking up, but so far no problems to report. the headlights are heading south on 101. still, as you mentioned, the fog is expected to make this tuesday morning back to work commute less than ideal. according to christina loren, visibility is down to less than 200 feet in some areas. the fog is along 680 and the sunol grade. also on the san mateo and dumbarton bridges. it is expected to be the thickest at sun rise, so that's the heart of the commute. drive accordingly. the worst thing you can do is turn on the high beams. that only makes visibility worse. so use your low beams and fog lights today. of course, you are going to want to reduce your spee

marla tellez joins us from morgan hill this morning. the usgs reports people could feel the shaking all the way up to san francisco. >> reporter: that is absolutely right, laura. good morning to you. yes, the quake hit south of here so it's kind of a surprise that people could feel it in san francisco. it happened shortly before 1:00 this morning precisely at 12:51 a.m. according to the usgs, the u.s. geological survey, it measured a 4.5 on the richter scale and it hit six miles southeast of san juan batista. many of you know that is located in san benito county. neighboring cities are hollis r hollister. that is about 45 miles south of san jose. the epicenter was 5.2 miles deep. it did hit on the infamous san an dreas fault. a 3.4 aftershock hit at 1:00 this morning. now, so far no reports of damage so good news there but we did find a gentleman in morgan hill, he happened to be here this morning, he said he certainly felt it in his home. >> yes, i did. it woke me up this morning about 12:50 this morning. it was pretty strong. it rocke

marla tellez is here with a preview of what we'll hear later on this morning.t is an amazing story. >> reporter: it is. good morning to you. it was only nine days ago that jacob trette almost drowned after being knocked bay giant wave near half-moon bay. today he's recovering at his parents' home in orange county. and the "today" show will interview him and his friend who was in the water with him. that's going to happen later this morning. now, it was saturday the 22nd when the southern california surfer was caught by about a 20-foot wave and then found floating face down. trette was airlifted to stanford medical center and listed in critical condition. in a short amount of time he has gone from a medically-induced coma to stable and now out of the hospital. it was only trette's second time surfing at the infamous maverick site known for the annual big wave surfing competition. his first time being just a day before on that friday, the 21st. the friend surfing with him describes what happened. >> it was a very set of waves that came through. it was a rogue set

i'm marla tellez in for scott mcgrew. let's check on the morning forecast. >>> you can't see anywhere you head. all three bays are socked in with fog this morning. waking up in the east bay with visibilities less than a quarter of a mile. livermore, in terms of feet, santa rosa, everywhere you head you will encounter patchy dense fog. it is like pea soup out there, and i don't use that term loosely. you have to take it easy. a lot of people don't go to work today. that's good news because we would definitely see a slow commute as a result of the fog. the high pressure is actually compressing the moisture we have leftover from the system that passed through last week. that's creating the fog. but as we head throughout this afternoon a lot of sunshine will make its way over the bay area. so it will be a pretty nice second half of the day. we have a lot of fog to get through first, but this is where our temperatures are slated to end up around 3:00 p.m. this afternoon. 64 in san jose. 62 for redwood city. 59 in san francisco

marla tellez has a look at the tax proposals. particlea? >> extensions rarely farewell, but if they reject tax extensions, governor brown could mean the proposed cuts will double. they had a series of tax increases that were passed as part of the budget solutions in '09. they include a quarter percent surcharge on each income tax rate. a reduction in the credit for dependents from $227 down to $99 a 1 percentage point increase in the state sales tax to 5% to 6%. vehicle licensing fees of 1 to 2% of a car's value. they want to change how they calculate the car's taxes and do away with benefits. all of this would bring in $12 billion over a year and a half. keep in mind voters rejected the package of tax extensions in may of 2009. we will see if they have a change of heart in june. governor brown wants californians to think about if voters don't agree to extend taxes. the already cash-strapped k-12 system could face an additional $2 billion in cuts. as mentioned, california is facing a $25.5 billion deficit. the governor's proposed budget sla

marla tellez is live along the embarcadero below 880 with what drivers need to look for. marla?e are on embarcadero this morning. right behind me is fifth avenue. we are below 880. the construction you see here and equipment is all part of the fifth avenue improvement project that got started in the summer of 2009. about a year and a half ago. the whole point is to retro fit the bridge portion of 880. here's what's happening today. from 7:00 this morning until 4:00 this afternoon, fifth avenue between embarcadero and east eighth street will be closed. the detour signs are posted for drivers. this should only affect northbound 880 traffic today and drivers are being advised to stay away. do not take the embarcadero exit. instead you are advised to take the oak street off-ramp. once you do that, signs will be posted directing you to your original route. southbound traffic should not be affected today. here's a background on the project. the fifth avenue bridge was built in 1949. it has endured 60 years of wear and tear. the construction will strengthen and widen that part of the b

marla tellez joins us to make sense of it all >> the number of homes that were in some stage of foreclosure fell by almost 5%. that was good news released today. this was a missed mexage for two reasons much of what happens depends on the trend of unemployment. the thought is more people go to work and more people stay in their homes. they don't factor in a backlog of homes or are already foreclose and just not lifted yet. regardless realty track reports shows over 51,000 homes were in a stage of foreclosure and 2010 is a 4.7% decrease from 2009. for the month of december, about 61 human human homes were in foreclosure, a 25.5% drop from december of '09. a 9% increase from the month before in november. nationally it's a different story. a record number of homes are in a stage of foreclosure compared to a year ago, 2.9 million homes. >>> encouraging news, you but 1 in 25 homes in the state is currently in foreclosure. that is the stark reality. coming up in the 6:00 hour, i will break down the new numbers county by county and get a sense of what's happening in your neighborhood >> good to no

"today in the bay's" marla tellez is here with encouraging numbers. >> reporter: it is encouraging for those of you unemployed. a majority of california businesses plan to hire new employees and give raises in 2011. now, this is according to the employers association of america. the 2011 economic trend survey shows 54% of businesses plan to increase the workforce. 40% of businesses plan to do the same nationwide. also encouraging, more than six in ten businesses statewide expect to up their employees' pay. and 54% also plan to keep 401(k) retirement matching contributions in place this year. this latest survey shows employers are feeling more confident about the economy but given the depth of the recession they do remain cautious. now, if, in fact, employers follow through and start adding staff, california's more than 12% unemployment rate should soon drop. brent and laura, back to you. >>> new this morning, an overnight car fire in san francisco and a body was discovered in the car's charred remains near rose and western streets. we do have a crew headed to the scene. we'll have a li

"today in the bay's" marla tellez is here with a preview. >> reporter: laura, this is not the first time he has taken the stage at the state capitol as the third-term governor. jerry brown has delivered a state of the state address, but perhaps never in such dire economic times. his speech is expected to focus on california's nearly $25.5 billion deficit. and 12.5% unemployment rate. to solve the deficit governor brown wants to cut $12.5 billion and raise $12.5 billion more with cuts to state services and programs. he also wants to extend the tax hike added during the schwarzenegger administration, including a 1-cent increase in sales tax and the increase in vehicle license fees. those were supposed to expire this year. according to the sacramento papers, he is going to keep his address optimistic. he has a lot of stake concerning the public opinion. the public policy institute of california shows that 41% of californians approve of the job he's doing while 39% haven't made up their mind yet. many believe his approval rating is sure to rise if they like what he says. we'll stream the sta
