the loss of marlise is still obviously very raw for her family.h-old son is too young obviously to understand what's happened. from now at least he's spared from that heart break. earlier erick munoz and marlise's mom told me they want their story to be heard to save other families from going through the same nightmare. here's our exclusive interview. >> let's go back to when she first had the embolism. she was at that point 14 weeks pregnant >> yes. once we got to the hospital, and after the doctors do their initial procedures that they do to try to determine what's causing the problem, see if they can fix it, they showed us a c.t. of her brain. and i'm not a doctor, but you take enough stroke patients to the hospital and you see their c.t.s. because we see the c.t.s. we see them. i knew -- i guess i can't tell you exactly what i was looking at but i knew it was wrong. >> and even then, even in those early days, you were all on the same page. you felt you knew her wishes that she wouldn't want to be kept alive artificially through extreme measure

he was talking about marlise, the woman here. and he said the issue here is simply settled by the fact that the hospital says she's brain-dead. >> yeah. and i think this was a real missed opportunity for this judge and for the court. i've said all along when looking at this case, the law is unclear. the law is murky. that's what you heard from the hospital's lawyers. there is no legislative history, because i looked for it. i researched to find out debate on the legislative floor. why did they put this in? there is no definition as to whether or not the intent, the legislative intertent intent is to protect the second patient the child. we're still in the same place, john. this happened in 1999 in texas and the judge also found that brain-dead woman was dead and that the fetus didn't have a e fetal heartbeat and the judge ruled she should be unplugged. you have the situation now just happening again in 2014. and we just don't have any guidance, any clarity. and it's just -- i think it's heart breaking, i think it's tragic. we're

marlise munoz's husband has made new statements about his wife's condition. what's he saying? >> well, this comes from a court filing made late this afternoon. it's an affidavit that erick munoz, the husband of marlise munoz, has given to the judge that will be hearing this case tomorrow afternoon in ft. worth, and it really details the sadness and the horrific scene inside that intensive care unit where marlise munoz's body has been since november 26th, the night she collapsed of an apparent lung clot, blood clot in her lung. in it, erick munoz says "when i bend down to kiss her forehead, her usual scent is gone, replaced instead with what i can only describe as the smell of death." he goes on to say "one of the most painful parts of watching my wife's deceased body trapped in a hospital bed each day is the soulless look in her eyes. her eyes, once full of the glimmer of life are empty and dead. my wife is nothing more than an empty shell." and erick munoz just also goes on to say that all he wants to do is be able to put his deceased wife's body to rest. there is no mention

>> what next for the family is finding a place to bury marlise munoz. we have not heard directly, erick must not oss hasn't spoken, neither have their parents. we did get a statement from the attorney. it says, our client erick munoz authorized us to give today at 11:30 a.m. central time marlise munoz body was disconnected from life support and released to mr. munoz. they will proceed with the somber task of laying her body to rest and grieving over the loss suffered. went on to say, may marlise munoz rest in peace and the family find the strength to complete what has been a long and arduous journey. it's been eight and a half weeks since she was legally pronounced brain dead. an hour before we got this statement from the attorney, munoz family, we heard from the hospital. jps, john peter smith hospital behind me, this is what they sent to cnn. from the on set jps has said its role was not to make nor contest law but to follow it. on friday a state district judge ordered the removal of life sustain treatment from marlise munoz. the hospital will follow

what have you heard now from the attorneys representing the family of marlise munoz? >> anderson, just a little while ago, we had this statement. it's a lengthy statement, but in part, it reads that "according to the medical records" that the attorneys received "we have been provided that the fetus is distinctly abnormal. even at this early stage, the lower extremities are deformed to the extent that the gender cannot be determined." the lawyers also go on to say that they have information that suggests that the fetus is also suffering from hydro cephelus, which is abnormality on the brain, and other abnormalities, including a heart problem that cannot be specifically determined because they're unable to move marlise munoz's body. so, all of this going on, and this is exactly the kind of situation and details that the family says they do not feel like they should have been compelled to share with the world, but they say that in this case, because of all of the talk surrounding whether or not erick munoz, the husband of marlise munoz, wanted to have this baby come to t
