mar-a-lago compound. and they could bring the case in two different places, washington and florida. we are talking about venueit's a complicated legal concept. prosecutors could find venue wherever they need it to be in the federal system, and they are hearing testimony from a grand jury in florida. it could be just a sitting grand jury in florida that is hearing testimony, and that's what is happening as we have the trump lawyer visit that suggests the case is wrapped up and the trump team is very concerned the former president is about to be indicted. >> glenn, how common is it to use two separate grand juries in two separate location on what could be the same case? >> let me try and follow-up. it could be something as simple as the fbi went to mar-a-lago as part of its classified documents investigation and interviewed the witness and that witness lied to them. it may be that they don't want to bring what we call a 1001 case lying into the fbi into the case that we believe he could be indicted in washington, d.c. they might want it as a standalone perjury case, so to speak. the possibilities are endless. i

mar-a-lago is located down here. there was concern that one of the things of bringing this case in washington was the issue of venue. the fact is the former president left washington several hours before joe biden became president, and one of the things the trump lawyers raised was the issue that he was still authorized to have these documents for those several hours that he came down to palm beach and was still president before joe biden took the oath of office. that was one of the things that they decided finally again in recent months, jake, they needed to fix that situation by just bringing the case down here despite spending months collecting evidence and testimony from witnesses in the grand jury in washington. the question here, of course, is this is a -- perhaps a friendlier venue for the former president. he won this state, of course. the other issue, jake, is the q of whether they'll have to litigate again to use some of that really damning testimony we have from evan corcoran, his attorney, who recorded some of the things that the former president was saying to him. all of that, of course, will play out o

florida, which includes mar-a-lago, where this offense occurred, i suspect, for the most part, is where this case has to be tried. the department brought the charges in florida for the venue defense. >> as a former prosecutor in this district in the past, what else are you looking at and looking for, as we look ahead to what we see on tuesday? on t >> on tuesday, it will be pretty perfunctory. i believe this is a very sad day for this country. you have a former president coming in. the court will treat the president like any other defendant. he will be informed of his charges against him. they will be asked if he has counsel. he will walk in with his counsel. he will also be -- that's his initial appearance. and he will also be arraigned where he is asked to plead guilty or not guilty to the charges. he of course will plead not guilty. and the terms of his release will be set. in this case, clearly, i don't expect that the judges will impose a bond. i think they require him to be released on his own recognizance. the fact that he is a former president and he will come back to court. despite the historic nature of this indictment on tuesday, he will be treated just like an
