joel: this is the genius of john marshall. john marshall was a federalist.e was the last federalist in this country, basically. every single judge appointed to the court after john marshall was a republican. appointed by a republican president determined to overturn the jurisprudence of john marshall. and john marshall nevertheless, he participated in more than 1100 decisions in his 34 years on the court. in that time, more than half of those opinions, john marshall wrote himself, he wrote the longhand himself, and all but 35 of his opinions are unanimous. what does that say? that is a record we cannot possibly hope to equal today. john marshall had the personality and intellect to bring people together, to find common ground, to forge some sort of compromise in situations where nobody for a compromise was possible. -- to talking to a point a court appointed to be his opponents. but people like tim, they found him credible him and he worked very hard to find a middle ground. that is what is missing in the court today and what is so important in a democracy,

it turns out that in 1830, between marshall and his sons, the marshals own approximately 250 slaves. and it seems quite likely and in addition, it's the other 100 or so they may have added to the slaves but the slaves have been acquired and given to the sons. that leads to the question how did so many scholars miss this, how did so many scholars not notice these hundreds of slaves that john marshall was acquiring. i don't want to get into that because for one thing they are good friends of mine and i want him to remain good friends, i sent an email to friends that are marshall scholars and i said i just found this out, what do you think . >> i went to ancestry.com to see what for myself i was so interested in what you did. this scholars count said i was wrong and that he only had 62 slaves. i said 65 he said a dozen a.m. off by three and he's off by 62 , i also credit him with a dozen in richmond. the other scholar wrote back and said i wish i had done the research you have done . >> one of the questions about this, and this is a question about scholarship is, why have so many eminen

marshal -- i would be praying that mrs. marshal -- because it made a big difference. the big difference made was this. if mrs. marshal answered the phone, the justice would come on and he would be very civil. he would be very nice, very polite, very civil. if she did not answer the phone and you got to him first, it could be a very tough conversation. >> i remember about the capital cases that his charge to us was not merely to execute the formal dissent based on his categorical view. he said to us i want you to comb each of these cases to see if there is some specific ground under which we can get this reversed. this is not an abstract, he wanted to save a life. so those also came with the question have you dug into this? is there something specific about this case we can say? >> this is one of my memories. for many reasons capital punishment played even more significant role in the court than it does today. first off, there were more executions, so, you know, the week there would usually be several executions a week at that time. there were fewer procedural bars, so

and john marshall turned him down. instead he concentrated on his successful and lucrative private practice and argued the case against the supreme court but he impressed everyone that hurt his arguments. marshall finally agreed to become one of the emissaries sent to france to handle the troubles we were having. france was waging a war against the united states. john adams decided to negotiate his way out of it. they went to meet with the minister of foreign affairs. an intermediary told them you are going to need to give us money. and john jay came back without paying the bribe . people were very upset with france for understandable reasons. congress eventually declared a naval war passing a series of statute's and that-- allowing naval vessels to attack french naval vessels. so that first foray did not work out so well but apparently john adams was impressed with john marshall. he offered to make a john marshall secretary of war. john adams sent his name to the senate anyway and before the senate could act, the secr

but john marshall, of course, rightly having an incredible legacy. are there any other justices or chief justices, maybe a surprise justice, that you feel was one of the great ones who has an important legacy on the court? >> well, taft. i mentioned him briefly. chief justice taft had been president. he always wanted to be on the supreme court. he declined twice when roosevelt offered him the job. he was then governor of the philippines and he had to complete his mission there, which was giving them a government. his wife always wanted him to be in politics. once he fulfilled that obligation to her, he became chief justice. as you'll see in a book about to come out, a biography by jeff rosen, i think jeff correctly portrays him as the most judicious of presidents, the most presidential of chief justices. he would not lobby the congress. he would send them a bill. he lobbied to get the things the court needed. >> do you think his career as a president having served as president and having served in so many senior administrative capacities made him a b
