so that will give it's a marshawn, some clarity. so there's that reason to do it too. but most of all i have to say and it's kind of monday morning quarterbacking. but when you think of instances where the defendant wants something and the prosecutors don't object. 99 times out of 100, the judge is going to go with that because the parties are more or less on the same page and that's what he did here. so we probably they all should have seen this coming really as soon as da bragg and his team decided not to oppose until leave it in the hands of the judge and ron, the trump team is welcoming this news. >> obviously. and they even as they capitalize, even as he really capitalizes politically on whatever legal developments it's come his way. clearly they wanted to punt this one beyond the election. what do you think about the kind of effect that it could have had that they may have been worried about yeah, look, it's funny because the judge said he didn't want to influence the election. but obviously not sentencing before the election is a way of influencing the election.

supreme court case, but i do have to ask you because tomorrow we are going to find out from judge marshawn here in new york who you know, very well. i should i should note for anyone who's forgotten, as we've talked about it, ad nauseam, about whether or not he's sentencing donald trump 13 days from now, or if he's going to wait until after the election, what's your sense? >> my sense is that he probably hasn't made that determination. i would say he is. if he does and he's if he doesn't, either, he sentences him just before the election and he's criticized because he because it's too close the election or he waits and he looks weak and he's punted it. if i were him and i don't know what he's going to do i would wait till after the election. i would issue my three 30-30 post judgment decision and i would sentence him if he hasn't granted the motion the same day, that would be the end. >> well, it's good to have you booked tomorrow night's will see what happens next 24 hours judge konviser. great to have you both up next year or unimportant follow up on a story that we broke here last night

juan marshawn, who presided over that trial, has informed both trump's team and the manhattan district attorney's office that he will decide today whether to postpone donald trump's sentencing. he's currently scheduled to be sentenced on september 18. trump's lawyers asked for that to be delayed until after the november election, saying that if the judge rules against them in there attempt to get the entire verdict thrown out based on the supreme court's ruling on presidential immunity, they say they won't have enough time to appeal that decision. so they've asked the judge to push this off. the prosecutors have not oppose that, requesting that they had afforded the judge. so ultimately, what the judge decides today will let us know if donald trump is going to face a sentencing before the election, or if it will come sometime after john, that will be fascinating. all right. kara scannell, a lot going on today. thanks so much for being with us this morning. good news for drivers. the country pumping so much oil, the gas prices could drop below $3 by thanksgiving. >> and brand, brand new

sentencing could impact the outcome of voting in november and this is interesting because judge juan marshawn has rarely can seated the trump legal team's arguments in and around politics. but here we also have a new additional element and that is the supreme court's decision on presidential immunity. >> that could impact this case. the judge pointed out that he routinely pushes back sentencing for all kinds of reasons. and looking at all the factors here, he's decided to push this back back until late november know if trump is re-elected, i would expect that his lawyers will try to get this sentencing pushed back even further, arguing that you can't sentence a president elect. you can see in this calendar right now, this would happen several weeks after the election, but also after the decision by this judge about whether this case survives after the supreme court granted trump some immunity, it is widely expected that this case will survive if trump is not reelected, he walked to face this sentencing in addition to three other criminal proceedings currently pending. wolf are chief legal aff
