president miguel: commissioner martinez? commissioner martinez: i also want to address something that mrs. jackson said, which upon reflection i realize maybe there's a misunderstanding about the historic district. every historic district is different. and every historic district has a different set of rules about what you can and can't do. and that set of rules is put together when you're establishing the district. and so the formulation of the rules is part of the public process that happens when you decide to do the districts. so the public will have full input on what the rules really are. and if the rules in the district say whatever your fence is, it's fine, nobody will bother you about the chain linked fence. some districts he -- districts -- the cottage row, the people changed the fentions and the people were very -- fences and the people were very upset. so we had to change the district to include fences because people were very upset that there was a tradition of no fences and some people started to put up really b

i think that commissioner martinez raises an interesting point as has commissioner buckley in the past that maybe we can use historic preservation as a tool for stabilizing certain disadvantaged communities but i don't think we have many examples of it and that's why we need to be sensitive to how we codify a lot of the language in 10 and 11 and around the historic district designation as commissioner moore points out because we don't have a lot of examples of how maybe the potential there, maybe san francisco will be the place where this is sort of defined, so then let's take on the challenge and define that in language that really does support these goals and these values and i think that we have enough of a diverse group here we can maybe actually find ways along with the city attorney, members of the public involved in the discussion to make sure that the language is there. but i just think that we have to -- we're in unchartered territory as far as historic preservation and stabilization of communities. and we're all ready to step up to that challenge and see how we can address al

this morning it heads to martinez superior court. mark sayre is in martinez to explain what's being challenged. good morning. >> reporter: good morning. at issue here is the ballot counting process in contra costa county. but first, let's show you just how close this congressional race is. now, several days after the election incumbent jerry mcnerney a democrat has 47.7% of the vote. the republican challenger david harmer, well, he has 47.4%. vote. so that brings us here to superior court in martinez where david harmer's camp is challenging the registrar of voters of contra costa county saying that harmer's representatives are not being allowed close enough to see ballots or to verify addresses on mail-in and provisional ballots that are being counted. mcnerney's camp has no objections to the vote counting process. the republican camp went to court to stop the counting. incommissioner denied that and they are going to court morning to. this congressional district covers several counties including alameda, santa clara and san joaquin
