do you think bergdahl should be court-martials? >> well, look, i'm a combat veteran. fifth tour in afghanistan. i've heard what all the young men who served with bergdahl have to say. i'm with all of them. this guy needs to be charged with; but the problem is going to be the element of proof in whatever he might be charged with which could range from awol, away without official leave, desertion which is the key word people are use right now, or in james rosen's report, corroboration with the enemy, a lot he could be charged with. the question is what are the elements of proof that are going to get a conviction, and it will be difficult, no matter what. >> so you definitely believe he should be court-martials. i ask you, would a psychological evaluation have to take place first to determine if or when bergdahl would be ready for a trial? >> yeah. that's a great question, arthel, that, i mean, among many other things. we know he's in germany not only getting a medical evaluation, certainly talking to intelligence people who are trying to glean whatever they can about wh
