lee martinez. ktvu fox 2news. >>> east bay mud officials say they still have a lot of work to do to fix a sewage leak that spilled in to the estuary. that leak released more than one million gallons from a treatment plant last month. rob ross has more on the challenge to fix that toxic problem. >> reporter: the estuary dodged a bullet during the weekend rains. unlike the december storms when a million gallons of partially treated sewage spilled in to the water prompting warning signs for boat terse avoid contact with the water east bay mud said there was no such problem this is time. >> the rain didn't come down in the same way it did in decembert. was prolonged over a two day period of time. less than ten cities. we were able to manage the flow in to the systemful. >> reporter: east bay mud said its water treatment plant gets soaked with sewage and stormwater causing a hazardous mix. >> what happens when it rain social security is stormwater comes in in all those places. the city is system, into o

the martinez family says he still unsure why he broke in.the family also says.they plan to file a restraining order. an arizona state trooper is recovering. after being attacked by a man he was trying to help. >> pam:the trooper had pulled over to help a man whose car had flipped over. police now believe the driver inside---- leonard pennelas escobar--- used to be a mexican federal officer. escobar's girlfriend was ejected from the car and later died. but as the trooper approached escobar to help. escobar pulled out a gun and shot him. then started beating him. that's when a good samaritan pulled over and shot escobar with his own gun. but it wasn't over yet. "the suspect gets up a second time and begins to attack them again. as the suspect approaches the good samaritan fires another round this time striking the suspect in the head mortally wounded him and ending the fight." the reason why escobar attacked is not known. and although police say he was a known drug user--- as far as they know, he did not have a criminal history. the bay area m
